foreword

1. Technical Regulations of the Customs Union "On the safety of products intended for children and adolescents" is designed in accordance with the Agreement on common principles and rules of technical regulation in the Republic of Belarus, Kazakhstan and the Russian Federation of November 18 2010 year.

2. This technical regulation is designed to establish the common customs territory of the Customs Union of uniform mandatory for the application and enforcement of the requirements for products intended for children and adolescents, to ensure the free movement of products intended for children and adolescents into circulation in the common customs territory of the Customs Union.

3. If, in respect of products for children and adolescents will be taken other technical regulations of the Customs Union and (or) technical regulations of the Eurasian Economic Community (hereinafter - EAEC), which establish requirements for products intended for children and adolescents, the products intended for children and adolescents, must meet the requirements of the technical regulations of the Customs Union and (or) EurAsEC technical regulations, the action of which it is subject.

§ 1. Application area

1. These Technical Regulations apply to products intended for children and adolescents have not been in operation (new), put into circulation in the territory of the Customs Union member states, regardless of their country of origin. For products covered by the scope of this technical regulations include:

  • products for the care of children (milk nipples, pacifiers, crockery, cutlery, hygiene and clothing accessories, toothbrush and gum massager);
  • clothing, articles of textile materials, leather and fur, knitted and are custom-made textile articles;
  • shoes and leather goods; Baby carriages and bicycles;
  • publishing books and magazines, school supplies.

Requirements of these Technical Regulations are set for products on the list in accordance with Annex 1.

The present technical regulation does not apply to:

  • products developed and manufactured for medical use; baby food;
  • perfumes and cosmetics; sporting goods and equipment;
  • manuals, textbooks, electronic educational publications; toys, games, desktop printing;
  • furniture, products made by individual orders

2. This technical regulation establishes mandatory safety requirements for products intended for children and adolescents in terms of chemical, biological, mechanical and thermal safety to protect the lives and health of children and adolescents, as well as prevention of actions misleading users of the product.

§ 2. define

This technical regulation, the following terms and their definitions:

  • biosecurity - The state of the product for which there is no unacceptable risk associated with bodily harm or threat to life due to the mismatch Users microbiological, toxicological, physical and physico-chemical properties of the requirements;

  • output into circulation - Placing on the market of the Member States of the Customs Union of products sent from the manufacturer warehouse, the seller or the person performing the functions of the foreign manufacturer, or shipped without storage, or exported for sale in the territory of the Member States of the Customs Union;
  • children - Production users under the age of 14 years;
  • distributor - Natural or legal person in the supply chain, with the exception of the manufacturer or importer, manufacturing products on the market;
  • Identification of products - The procedure for inclusion of products for children and adolescents to the scope of this technical regulation of the Customs Union and the establishment of conformity and technical documentation thereto;
  • manufacturer - A legal entity or natural person as an individual entrepreneur acting on its behalf for the production of children and adolescents for the subsequent implementation and responsible for its compliance with safety requirements of this technical regulation;
  • importer - A resident of a Member State of the Customs Union, which concluded with a non-member state of the Customs Union agreement on the transfer of foreign products to children and adolescents, is implementing these products and is responsible for its compliance with safety requirements of this technical regulation;
  • toxicity index - Integral indicator of exposure to harmful substances, determined in cell culture;
    mechanical safety - A set of quantitative indicators of mechanical properties and structural characteristics of the product, which reduces the risk of injury or threat to the life of the user;
  • newborns - Children under 28 days inclusive;
  • circulation of products for children and adolescents in the market - The movement of the product from the manufacturer to the user, covering all processes that passes said products after its production;
  • Teens - People aged products to 14 18 years;
  • users of products - Children, teenagers, personal use products, which is the object of this technical regulation;
  • intended use - The use of products for children and adolescents in accordance with the purpose specified by the manufacturer (manufacturer) on these products and (or) operational documents;
  • risk - A combination of probability of harm and consequences of harm to human life or health, property, the environment, human life or health of animals and plants;
  • sports articles - Products that provide the necessary conditions for organizing and conducting competitions and training in various sports;
  • a representative sample - Sample representative articles belonging to the same species for its intended purpose, designed for the same age group, made by the same manufacturer of the same materials in the same recipe and one technical documents regulating the output;
  • person authorized by the manufacturer - Natural or legal person, duly registered by the State Party which is specified by the manufacturer on the basis of a contract with him for action on its behalf in conformity assessment and placement of products on the customs territory of the Parties, as well as to lay the responsibility for non-conformance to the requirements of technical regulations customs union;
  • chemical safety - The state of the product for which there is no unacceptable risk associated with bodily harm or threat to life due to the user's excess concentration of harmful chemicals member.
    If chemical safety indicator set to "not allowed", it is mandatory to specify the limit of detection of harmful substances by measurement procedures authorized for use to control the sanitary-chemical parameters.

§ 3. Handling on the market

1. Products for children and teenagers released into circulation on the market of the Member States of the Customs Union in its present compliance with technical regulations and other technical regulations of the Customs Union, the action of which it is subject, it should then go through the procedure of mandatory conformity and shall be marked with a single sign of products on the market of the Member States of the Customs Union.

2. Products for children and adolescents, conformity to the requirements of this technical regulation is not confirmed, should not be marked with a single sign of products on the market of the Customs Union member states and not allowed to be released into circulation on the market.

Article 4. Product safety requirements for child care

1. Products for child care must meet the following general safety requirements:
toxicity index, determined in an aqueous medium (distilled water) should be in the range of up to 70 120 percent, inclusive, or there should be no local irritant effect on skin and mucous membranes.
change in pH of the aqueous extract should not exceed ± 1,0.

2. Dairy nipples, pacifiers and sanitary products made of latex, rubber and silicone elastomers must comply with chemical and mechanical safety. There shall be no taste of the water extract. Isolation of harmful chemicals shall not exceed the following rates:
during the test nipple milk and pacifiers of silicone polymers: lead - not allowed; arsenic - not allowed; formaldehyde - not allowed; methyl alcohol - not allowed; butyl alcohol - not allowed; phenol - not allowed; zinc - no more 1,0 mg / dm3; antioxidant (Agidol-2) - no more 2,0 mg / dm3;

when tested latex, rubber nipple milk and pacifiers:
lead - not allowed; arsenic - not allowed; antioxidant (Agidol-2) - no more 2,0 mg / dm3; N-nitrosamines (extraction with methylene chloride) - no more 10,0 mcg / kg; N-nitrozoobrazuyuschie (extraction with artificial saliva) - not more than 200,0 mcg / kg; tsimat (zinc dimethyldithiocarbamate) - not allowed; phthalic anhydride - no more 0,2 mg / dm3; phenol - is not allowed.

Milk nipples and pacifiers should be smooth with no seams outer and inner surfaces, which should not stick together after boiling 5-fold in distilled water.
The pacifier should be hockey (shield). Strength of the connection ring with balloon in the pacifier should be at least 40 N.

Products Sanitation of rubber, designed to care for children, should be resistant to disinfection 5-fold, store appearance and do not have to stick together. Products are filled with liquid (hot water bottles, and other similar products) should be sealed and should not leak water. Products Sanitation rubber must meet the requirements of chemical safety in accordance with Annex № 2.

3. Crockery and cutlery made of plastic should not have sharp (cutting, pricking) edges and edges, unless it is determined by the functional purpose of the product. It is not allowed to protrude the gate above the supporting surface. Protective-decorative coating of the product must be resistant to the action of wet processing. Products intended to come into contact with food must be resistant to an 1-percentage solution of acetic acid and soap-alkaline solutions heated to a temperature of 60 ± 5 ° C, to preserve its appearance and color, not to deform and not crack when exposed to water at temperature From 65 to 75 ° C.
Cap bottles and other similar products must ensure their integrity and keep water out. Strength of the product must be such that after 5-fold drop items filled with water from a height 120 cm was observed permanent deformation, cracks, chips or damage.
Flavor and color change of the aqueous extract of products intended for contact with food are not allowed.
Kitchen utensils and tableware made of plastic must comply with chemical safety in accordance with Annex № 3.
Making children's dishes, which have direct contact with food, using polycarbonate, PVC, melamine is not allowed.

4. In the children's goods intended for contact with foodstuffs, the migration of chemicals 1-th and 2-hazard class (including aluminum, barium, boron, cadmium, cobalt, arsenic and lead) is not allowed.
The release of harmful substances contained in a pot of glass, glass and ceramics, in terms of chemical safety should not exceed the following values:
chrome - 0,1 mg / dm3; manganese - 0,1 mg / dm3; Copper - 1,0 mg / dm3; Titanium - 0,1 mg / dm3; Zinc - 1,0 mg / dm3.

Crockery and cutlery, designed for hot food must be thermally stable and must not break when temperature drops 95 - 70 - 20 ° C, bottles and jars of baby food - at temperature drops from up 95 45 ° C, the bottles as dairy products - at temperature drops from up 65 25 ° C. Thermal stability of earthenware with colored glaze must be at least 115 ° C, with a colorless glaze - at least 125 ° C.

Coating on the inner surface of the articles in contact with food must be acid-resistant. No decorative coating may be applied to the inner surface of glassware.
Products are not allowed on the chips, slit edge, stuck pieces of glass, cutting or crumbling particles through perforation and foreign inclusions, having around him crack.
Fixing handles products and elements of decoration should be durable. Handle glassware must withstand a load equal to the capacity of the product when lifting the handle for 1 minutes. Handle ceramics to withstand a one-time load mass twice the mass of water that fills a product with a method of lifting the handle.

The release of harmful substances from the crockery and cutlery made of metal intended for contact with food must not exceed the following rates:

  • tableware made of corrosion-resistant steel - iron - 0,3 mg / dm3, nickel - 0,1 mg / dm3, chrome - 0,1 mg / dm3 and manganese - 0,1 mg / dm3;
  • tableware made of aluminum with an etched, polished quartz and the inner surface, including the non-stick coating - titanium - 0,1 mg / dm3, iron - 0,3 mg / dm3 and chrome - 0,1 mg / dm3, aluminum is not allowed, fluorine ion (total ) is not allowed for products with non-stick coating;
  • crockery and cutlery aluminum clad stainless steel surface - aluminum and lead - not allowed, copper - 1,0 mg / dm3, zinc - 1,0 mg / dm3, iron - 0,3 mg / dm3, nickel - 0,1 mg / dm3 and chrome - 0,1 mg / dm3;
  • tableware made of nickel silver, nickel silver with silver or gold plating - lead - not allowed, copper - 1,0 mg / dm3, zinc - 1,0 mg / dm3, nickel - 0,1 mg / dm3, chrome - 0,1 mg / dm3, manganese - 0,1 mg / dm3 and iron - 0,3 mg / dm3;
  • steel enameled cookware, including with non-stick coating - boron, aluminum, cobalt, lead and arsenic - not allowed, nickel - 0,1 mg / dm3, chrome - 0,1 mg / dm3, manganese - 0,1 mg / dm3, zinc - 0,1 mg / dm3 and titanium - 0,1 mg / dm3 fluorine ion (total) is not allowed for products with non-stick coating;
  • Utensils made of paper and cardboard (single use) - ethyl acetate, formaldehyde, methyl alcohol, butyl alcohol, isobutyl alcohol, benzene, lead, arsenic - not allowed, acetaldehyde - 0,2 mg / dm3 acetone - 0,1 mg / dm3, toluene - 0,5 mg / dm3, zinc-1,0 mg / dm3, chrome - 0,1 mg / dm3, butyl acetate - 0,1 mg / dm3, isopropyl alcohol - 0,1 mg / dm3, xylenes (mixed isomers) - 0,05 mg / dm3

5. The release of harmful substances from metal sanitary and clothing accessories must not exceed iron - 0,3 mg / dm3, aluminum - 0,5 mg / dm3 and lead - 0,03 mg / dm3. Products Sanitation of metal must be resistant to corrosion. Fixing handles and decorative design elements, fittings and coatings must be durable.

6. Hygiene and haberdashery products from plastic (scissors, combs, brushes and other similar products) should not have sharp (cutting, pricking) edges, unless it is determined by the functional purpose of the product. Sanitary and hygienic products must preserve appearance and color, do not deform and do not crack when exposed to water at temperatures from 65 to 75 ° C. There should be no erasure of the dye when wiping the product. The fixing of the handles should be strong and withstand a static load exceeding the containment mass by at least 2 times. The deformation along the width of the baby bath filled with water by three quarters of the height should not exceed 1,5 percent. Hygienic and fancy goods made of plastic must comply with the requirements of chemical safety in accordance with Annex 4.

7. Toothbrushes, toothbrushes electric powered chemical current sources, gum massagers and similar products for oral care must comply with the chemical safety in accordance with Annex 5.
Tooth brushes, electric toothbrushes powered by chemical power sources for children up to 12 years must be made soft (hardness less than 6 cN / mm2), for children older than 12 years and adolescents - medium hardness (degree of rigidity not less than 6 cN / mm2 and Not more than 9 cN / mm2 inclusive). Synthetic fiber in brush brushes should be without burrs and have rounded ends. The strength of fixing the brush brushes toothbrush must be at least 15 N. 8. Sanitary-hygienic disposable childcare must comply with the microbiological safety in accordance with Annex 6.
Products Sanitation containing gelling desiccant materials should not show a sensitizing action during compression 24 hours.

benzene - 0,01 mg / dm3 hexane - 0,1 mg / dm3, methyl alcohol - 0,2 mg / dm3, propyl alcohol - 0,1 mg / dm3 toluene - 0,5 mg / dm3, phenol - 0,05 mg / dm3 or the amount of total phenols - 0,1 mg / dm3 formaldehyde - 0,1 mg / dm3 ethyl acetate - 0,1 mg / dm3, lead - 0,03 mg / dm3 zinc - 1,0 mg / dm3 arsenic - 0,05 mg / dm3 and chromium (III) and (VI) (total) - 0,1 mg / dm3.
The release of harmful substances contained in products sanitary cellulose and wool shall not exceed acetaldehyde - 0,2 mg / dm3 acetone - 0,1 mg / dm3 benzene - 0,01 mg / dm3, methyl alcohol - 0,2 mg / dm3, butyl alcohol - 0,5 mg / dm3 toluene - 0,5 mg / dm3 formaldehyde - 0,1 mg / dm3, ethyl acetate - 0,1 mg / dm3, lead - 0,03 mg / dm3, zinc - 1,0 mg / dm3, arsenic - 0,05 mg / dm3 and chromium (III ) and (VI) (total) - 0,1 mg / dm3.

Article 5. Safety requirements garments, textiles, leather, fur, knitwear and textiles finished piece

1. In accordance with the function of clothing and products are divided into clothes and products 1-th, 2-th and 3-th layers.

  1. For clothes and products 1-layer products are in direct contact with the skin, such as undergarments and linen, corsetry and swimwear products, hats (summer), hosiery, handkerchiefs and headaches and other similar articles .
  2. For clothes and products 2-layer include products having limited contact with the skin, especially dresses, blouses, tops shirts, pants, skirts, suits unlined, sweaters, pullovers, hats (except summer), mittens, gloves, Hosiery autumn-winter range (socks, knee-high) and other similar products.
  3. To dress 3-layer include coats, jackets, coats, suits lined envelopes for newborns and other similar products.

2. For children up to one year (range of sizes - up growth 74 cm, chest to 48 cm) clothing textiles, knitwear and ready-made textile products must meet the requirements of biological and chemical safety.
Clothing and articles 1-layer - linen, knitwear and garments of textile materials must meet the following standards:

  • hygroscopic - at least 14 percent;
  • breathability - not less 1 5 0dm3 / m2s for products of flannel, fustian and lined (napped) knitted fabrics allowed at least 70 dm3 / m2s;
  • free formaldehyde content - not more than 20 ug / g;
  • color fastness to washing, perspiration and rubbing dry - at least 4 points.

Clothing and articles 2-layer - knitwear and garments of textile materials must meet the following standards:

  • hygroscopic - at least 10 percent;
  • breathability - not less 100 dm3 / m2s for products of flannel, fustian lined (napped) knitted fabrics and materials with polyurethane threads wait at least 70 dm3 / m2s;
  • free formaldehyde content - not more than 20 ug / g;
  • color fastness to washing, perspiration and rubbing dry - at least 4 points.

Clothing 3-layer - knitwear and garments of textile materials must meet the following standards:

  • hygroscopic (for lining) - at least 10 percent;
  • breathability (for lining) - at least 100 dm3 / m2s; for the lining of flannel, fustian, denim and corduroy fabrics lined (napped) knitted fabrics - at least 70 dm3 / m2s;
  • free formaldehyde content - not more than 20 ug / g;
  • fastness to washing materials top, sweat, friction and dry distilled water - at least 3 points lining color fastness to washing, perspiration and rubbing dry - at least 4 points.

The clothes 3-layer without lining made of materials having a permeability less 10 dm3 / m2s shall be provided to ensure the structural elements of air.

3. For older children and adolescents, the garments and garments of textile materials must comply with biological and chemical safety in accordance with Annex 8.

4. Textiles for clothing and products must comply with the requirements for color fastness, according to Annex 9.

5. Products for newborns and linen products for children under the age of 1 year must be made of natural materials, with the exception of the excipients. Joint seams with buttonhole cuts in linen products for babies should be made on the front side. External and decorative elements in products for babies and underwear products for children under the age of 1 years (lace, embroidery, applique, and other similar items), made of synthetic materials do not have direct contact with the baby's skin.

7. Textiles for clothing and products must comply with the chemical safety in accordance with Annex 10. The list of controlled chemicals is determined by the chemical composition of the material and the type of products

Harmful substances in clothes 1-th and 2-th layers are determined in an aqueous medium in the articles 3-layer (except products for infants and children under 1 years) - in the air. In products 3-layer for newborns and children up to year 1 harmful substances are defined in the air and water environments.
Index of toxicity, when tested in the aquatic environment should be up from 70 120 percent, inclusive, in the air - from up 80 120 percent, inclusive, or there should be no local skin-irritating action in clothing and products 1-th and 2-layer.
Emission of volatile chemicals contained in textiles, processed coupling agents, shall not exceed standards according to Annex 11.

8. Leather clothing, hats and leather goods must meet the following requirements:
free formaldehyde content - not more than 20 ug / g; Water leachable content of chromium (VI) in the skin is not allowed;
skin color fastness to dry friction - at least 4 points, skin color fastness, except leather for gloves and mittens to wet friction - at least 3 points.

9. Textile fabrics used in clothing and headdresses made of leather, must comply with biological and chemical safety requirements for textile materials in accordance with Annex 10.

10. Clothing, envelopes, hats, gloves, mittens, and other similar articles of fur for children under 1 year must meet the following requirements:
Free formaldehyde content is not more 20 ug / g; Water leachable content of chromium (VI) is not permitted; pH of the aqueous extract of the leather - at least 3,5;
temperature welding leather fabric fur - at least 50 ° C;
color fastness to dry friction hair - at least 4 points to dry friction of the leather - at least 3 points.

11. Clothing and fur for children over 1 year must comply with the safety requirements in accordance with Annex 12.

12. Textiles and clothing products from fur must comply with biological and chemical safety requirements for textile materials in accordance with Annex 10.

Article 6. Safety requirements footwear and leather goods

1. Safety footwear and leather goods to assess the sustainability of the materials used to paint dry and wet friction and impact of sweat and concentration of pollutants emitted and complex physical and mechanical properties (mass, flexibility, strength fixing of bottom, deformation and toe shoes backdrop and breaking load of nodes fastening handles leather goods).
2. In the shoes are not allowed lining of the following materials:
- Of artificial and (or) of synthetic materials in closed shoes all age groups;
- Of artificial and (or) of synthetic materials in open shoes for toddlers and shoes for small children;
- Textile fabrics embedding fibers 20% more for toddlers and shoes for small children;
- Faux fur and flannel in winter shoes for toddlers. In the shoes Insoles are not allowed in the following materials:

In the shoes for toddlers as the top material is not allowed to use artificial and (or) synthetic materials, excluding the summer and spring and autumn shoes, lined with natural materials.

3. In the shoes are not allowed:
open heel portion for children under 3 years;
unfixed heel portion for children aged up to 3 7 years, except footwear designed for short jobs.

4. Leather for shoes must meet the following requirements: free formaldehyde content - not more than 20 ug / g; Water leachable content of chromium (VI) is not permitted; color fastness to dry friction - at least 4 points; color fastness to wet friction - at least 3 points; color fastness to perspiration impact - at least 3 points.

5. Shoes must comply with biological and mechanical safety in accordance with Annex 13.
Electrostatic field on the surface of the shoe should not exceed 15 kV / m

6. Leather goods must comply with the biological and mechanical safety in accordance with Annex 14 (table 1, 2).

7. Briefcases and backpacks for school should have the details and (or) hardware with reflective elements on the front, side and top surfaces of the valve and made of materials of contrasting colors. Backpacks for school for school-age children should be provided with a form-stable backrest.

8. Content of harmful substances in materials for backpacks, bags, student backpacks, portfolios should not exceed standards in accordance with the requirements of chemical safety in accordance with Annex 14 (table 3).

9. Content of harmful substances in materials for footwear and leather goods, except backpacks, handbags, student backpacks, portfolios should not exceed:
for fur - standards in compliance with chemical safety in accordance with Annex 12 to this technical regulation;
Skin - standards provided for shoes, clothes, hats and leather goods;
for textile materials - standards in accordance with the requirements of chemical safety in accordance with Annex 10 to this technical regulation;
for chemical and polymer materials - standards in accordance with the requirements of chemical safety in accordance with Annex 15.

10. Determination of emissions of harmful substances contained in materials of shoes for children under 1, as well as home, summer and beach shoes, gloves and mittens, small leather goods, carried out in an aqueous medium, the content of other types of footwear and leather goods - in the air.
Index of toxicity, when tested in the aquatic environment should be up from 70 120 percent, inclusive, in the air - from 80 120 percent to inclusive, or the inner layers of the shoe and in contact with skin leathergoods design elements should not have on the local skin-irritating .

Article 7. Safety requirements suitable for children and bicycles

1. Carriages for children should be stable on a horizontal and inclined (at an angle 10 °) planes, should have a braking and locking system. Carriages should not have sharp edges, knots and details that are in contact with the child. There should be no openings, slots with a diameter in the range greater than 5 mm and less than 12 mm. Open wheelchairs should have devices to prevent the child from falling out of the stroller (safety belts, fences and other similar devices), the back of the stroller must be form-stable. Brake and lock systems of wheelchairs should be inaccessible to the child in the wheelchair, or closing and opening them must be carried out simultaneously with two hands or with the use of special tools.

> Article 10. Ensuring compliance with safety requirements

1. Conformity of products for children and adolescents with this technical regulation is ensured by the security requirements of its compliance with the requirements, either directly or standardization documents included in the list of documents in the field of standardization, as a result of which, on a voluntary basis, compliance with these technical regulations.
Voluntary performance requirements of these instruments in the field of standardization indicates presumption of conformity with the safety requirements of the Technical Regulations.
2. State control (supervision) over observance of technical regulations of the Customs Union is held in accordance with the laws of the Member States of the Customs Union.

Article 11. Product Identification

1. Product identification on the grounds, including the name (specifying if necessary age or gender), type (appointment) product line of its field of application of these technical regulations and mapping products with the technical documentation it holds:
manufacturer (person authorized by the manufacturer), importer or distributor, claiming a product conformity requirements hereof and provides it in circulation in the territory of the Member States of the Customs Union;
Certification Body (assessment (confirmation)) to confirm the conformity of products subject to mandatory certification requirements hereof.

2. Are used to identify products organoleptic and instrumental methods:
2.1. with sensory identification products are identified by name and type (purpose) products, as well as its identity and characteristic features inherent in defined product type, in accordance with the standards and technical documentation;
2.2. the instrumental method for identifying product testing carried out in accordance with the approved list of international and regional standards, and in their absence - the national (state) standards of the Member States of the Customs Union, containing the rules and methods of researches (tests) and measurements, including the selection rules samples needed for the application and enforcement of the requirements of this Technical Regulation and implementation assessment (confirmation) of compliance products.

Article 12. Assessment (confirmation) of compliance

1. Before release into circulation on the market products must be subjected to the procedure of compulsory assessment (confirmation) of compliance requirements hereof, which takes the form of state registration with the subsequent declaration of conformity, declaration of conformity or certification.
When assessing (confirming) compliance, the applicant may be a legal entity or individual registered in accordance with the legislation of the Party in its territory as an individual entrepreneur who is a manufacturer or seller or performs the functions of a foreign manufacturer on the basis of a contract with him insofar as ensuring the compliance of the supplied product with the requirements of this Technical regulations and in part of the responsibility for non-conformity of the supplied products with the requirements of this of technical regulations.

2. Grade (s) of product compliance with these technical regulations in the form of state registration followed declaration shall be carried out for the following products:

  • dairy nipples, pacifiers latex rubber or silicone;
  • Product sanitary single-use (diapers, briefs, diapers, cotton sticks (for nose and ears);
  • crockery, cutlery for children under 3-years (cups, saucers, sippy cups, plates, bowls, spoons, forks, bottles, and other similar items for food);
  • toothbrushes, toothbrushes electric powered chemical current sources, gum massagers and other similar products for children under 3-years;
  • Product 1-layer underwear and knitted textile materials for children to 3-years; hosiery knitted 1-layer for children under 3-years;

State registration with the issuance of the certificate of state registration of products manufactured in the territory of the Customs Union, carried out at the stage of putting into production and products, first imported into the territory of the Customs Union, prior to its entry into the territory of the Customs Union.
Applicant for the purposes of state registration of products manufactured in the territory of the Customs Union is the manufacturer, and for products manufactured outside the territory of the Customs Union - a person who performs the functions of the foreign manufacturer, dealer, registered under the laws of the Member States of the Customs Union on their territory.
State registration of products authorized by the Party conducting body in the field of sanitary and epidemiological welfare of the population (hereinafter - the registration authority).

For the issuance of the certificate of state registration of the applicant, the following documents:

  • application;
  • copies of the documents, in accordance with which the products are manufactured (standards, specifications, regulations, technological instructions, specifications, recipes, information on the composition), certified by the applicant - for products manufactured in the territory of the Customs Union, certified in accordance with the legislation of the Party in which the State registration - for products manufactured outside the territory of the Customs Union;
  • document on the application of the manufacturer (operation, use) controlled products (product, management, regulation, recommendation) or a copy certified by the applicant;
  • copies of labels (package) or layouts-controlled products certified by the applicant;
  • act sampling (tests) - for products manufactured in the territory of the Customs Union;
  • written notice to the manufacturer that made them a product complies with the documents, according to which it is made, or copies of certificates of quality, safety data sheets (quality), certificate of quality, certificate of free sale, certified in accordance with the legislation of the Party which is held state registration - provided one of the following documents;
  • testing protocols testing laboratories (centers) of the authorized bodies accredited to national accreditation systems of the Parties and included in the Unified Register of certification bodies and testing laboratories (centers) of the Customs Union;
  • extract from the Unified State Register of legal entities, or the Uniform State Register of Individual Entrepreneurs (for products originating in the territory of the Customs Union);
  • Copies of documents confirming the import samples controlled goods into the territory of the Customs Union, certified in accordance with the legislation of the Party in which the State registration - for products manufactured outside the territory of the Customs Union.

Translation of documents from a foreign manufacturer into the state language of the Member State of the Customs Union shall be certified in accordance with the legislation of the Party in which the State registration.
Responsibility for the accuracy of the documents submitted for the purposes of issuing a certificate of state registration, the applicant bears.

State registration may be refused in cases stipulated by the legislation of the Customs Union.
State registration may be terminated by the registration authority in the cases established by the legislation of the Customs Union.

Verification of conformity of products subject to state registration is carried out by the declaration of conformity of production requirements hereof. The composition of the technical documentation attesting to such products the requirements hereof, including included certificate of state registration of products and test reports carried out for the purpose of state registration.

Used scheme declaration:
scheme 3d - Testing of samples is carried out by an accredited testing laboratory (center), production control by manufacturers (for serial production). When declaring the conformity scheme 3d applicant - registered in accordance with the legislation of the Customs Union member states in their territories the legal entity or natural person who is a manufacturer or performing the functions of the foreign manufacturer on the basis of a contract with him. Validity of the declaration - no more 5 years;
scheme 4d - the samples are tested in an accredited testing laboratory (center) (for a batch of products (single article).) When declaring conformity according to the scheme 4, the applicant is a legal entity or individual that is a manufacturer or is registered in accordance with the legislation of the Member States of the Customs Union Seller or performing the functions of a foreign manufacturer on the basis of an agreement with him.The validity of the declaration for serially produced products is for the period established by the declaration elem, starting from the planned date of the production, but not more than 3-years validity of the declaration on the consignment of goods -. for a period specified by the applicant, taking into account the shelf life (storage), but not more than 1 year.

3. Verification of conformity to the requirements hereof in the form of a declaration of compliance is carried out using the following schemes:
- 1d scheme or 2d - a declaration of conformity of production requirements hereof based on their own evidence, the validity of the declaration - no more 3 years, carried out for the following products:
leather goods;
school supplies;
- 3d scheme, or 4d 6d - a declaration of conformity of production requirements hereof involving a third party - an accredited testing laboratory (center), the validity of the declaration - no more 5 years, carried out for the following product groups:
clothing and products 3-layer knit, of textile materials and leather for children over 1 years and adolescents;
clothing, articles and fur hats for children over 1 years and adolescents;
hats 2-layer knit, of textile materials and leather for children over 1 years and adolescents;
piece-finished textile products; Shoes milled coarse-wooled;
book publishing, magazine production.

When declaring the conformity of production requirements hereof composition evidentiary materials should include:
- Copies of documents confirming that the applicant is registered in the prescribed manner by the State Party as a legal entity or individual entrepreneur;
- Test reports of samples of products, confirming that the products with the requirements of this technical regulation on safety indicators.
If the information contained in the test is not enough to identify the product, the evidence of the materials include operational documents, technical and design documentation, information on raw materials and components.
If the applicant is a dealer, then the composition of evidentiary materials include copies of documents confirming the origin of the products, copies of the contract (agreement), copies of shipping documents.
For products whose properties change over time, and products with a limited shelf life test report of samples of products to be decorated in period not earlier than six months before the date of the declaration.

Protocol testing of samples of the product shall contain:
- The date of issuance of the protocol and the number according to the system adopted in the testing laboratory;
- The name of the testing laboratory or the name and registration number of accredited testing laboratory (center) (depending on the scheme declaration);
- Name of the product;
- The name and the actual values ​​of the properties of the product verifiable indicators;
- Number and the regulations on the use of test methods.
At the request of the applicant's declaration of conformity of production according to the adoption of a declaration on the basis of his own evidence, may be replaced by the declaration of conformity according to the scheme of the declaration on the basis of evidence obtained from a third party, and the declaration of conformity can be replaced by certification.
When declaring the conformity schemes 1d, 3d, 6d applicant - registered in accordance with the legislation of the Customs Union member states in their territories the legal entity or natural person who is a manufacturer or performing the functions of the foreign manufacturer under a contract with him.
When declaring the conformity schemes 2d, 4d applicant - registered in accordance with the legislation of the Customs Union member states in their territories the legal entity or natural person who is a manufacturer or seller or performing the functions of the foreign manufacturer on the basis of a contract with him.

4. Verification of conformity to the requirements hereof in the form of certification, the accredited certification body with an accredited testing laboratory (center) in one of the schemes - 1s, 2s, 3s or 4s:
if the applicant is a dealer, a duly registered member state of the Customs Union, the validity of the certificate - no more 3 years, the frequency of surveillance of certified products - 1 once a year;
If the applicant is the manufacturer or the person performing the functions of the foreign manufacturer under a contract with him, the validity of the certificate - no more 3 years, the frequency of inspection control of the certified products - 1 once a year;
If the applicant is the manufacturer or the person performing the functions of the foreign manufacturer under a contract with him, having a certified quality management system, the validity of the certificate - no more 5 years, the frequency of inspection control of the certified products - 1 once a year.

Verification of conformity to the requirements hereof in the form of certification is carried out for the following products with the exception of products specified in paragraph 2 this article:

  • sanitary products made of rubber molded and unmolded for child care; hygiene products and clothing made of plastic and metal;
  • bed linen;
  • Product 1-layer underwear and knitted of textile materials;
  • hosiery knitted 1-th layer;
  • hats (summer) 1-layer knitted and textile materials; clothing and products 2-th layer of textiles and leather;
  • Product 2-layer knit;
  • hats 2-layer knit, of textile materials and leather for children under 1-year

5. To confirm the compliance of products with the requirements of this technical regulation in the form of certification, the applicant sends to the certification body an application for work and copies of documents confirming state registration as a legal entity or an individual entrepreneur. If the seller is the applicant, he additionally presents copies of documents confirming the origin of the product, a copy of the contract (contract), copies of the goods and transport documents. Depending on the certification scheme, the applicant presents copies of operational documents, technical and design documentation, information about raw materials, materials and components.

6. The certification body reviews the application and the documents attached to it, decides on the application, conducts product identification and sampling for tests, organizes the testing of product samples for compliance with the requirements of this Technical Regulation, analyzes the test results contained in the protocol, Compliance (non-compliance) with the requirements of this technical regulation, conducts an assessment of the manufacturer's production (analysis of the state of production), if This is stipulated by the certification scheme, takes a decision to issue a certificate of conformity or refuses to issue it, carries out inspection control over the certified products, if it is stipulated by the certification scheme, maintains a register of issued certificates of conformity, issues certificates of conformity, suspends or terminates the certificates of conformity issued by it, Informs about this the authorized bodies that ensure the formation and maintenance of national parts of the Unified Register of issued certificates Conformity.

7. Accredited testing laboratory (center) conducts tests and prepares the test report of samples of products.
Protocol testing of samples of the product shall contain:

  • date of issuance of the protocol and the room in accordance with the system adopted by accredited testing laboratory;
  • name and registration number of accredited testing laboratory;
  • Name of product;
  • name, factual and normative values ​​of the properties of the product verifiable indicators;
  • name of technical regulation, in compliance with the certification tests which are carried out;
  • number and the regulations on the use of test methods;
  • list of test equipment and measuring instruments used in the tests.

§ 13. Marking a single sign of products on the market of the Member States of the Customs Union

1. Products for children and adolescents meet the safety requirements of this technical regulation and have undergone assessment (confirmation) of compliance shall be marked with a single sign of products on the market of the Member States of the Customs Union.
2. Marking a single sign of products on the market of the Customs Union member states is carried out before the release of the product into circulation on the market.
3. Single sign of products on the market of the Customs Union member states is applied to each unit of production for children and adolescents or product label production unit.
4. May be applied as a single mark of products on the market of the Member States of the Customs Union only on the packaging indicating in the annexed operational documents of the impossibility of applying the mark directly on the unit (or product label) due to the peculiarities of the product.

§ 14. Safeguard clause

1. Member States of the Customs Union shall take all measures to limit, prohibition of issue of products for children and adolescents in the customs territory of the Customs Union member states, as well as the withdrawal from the market of products for children and adolescents do not meet the safety requirements of the Technical Regulations.

2. The competent authority of a Member State of the Customs Union shall notify the Commission of the Customs Union and the competent authorities of other Member States of the Customs Union of the decision stating the reasons of this decision and the provision of evidence, explaining the need for the measure.

3. The basis for the application of Article protection may include the following cases: failure to articles 4-7 this technical regulation of the Customs Union;
failure to comply with the rules set out in Article 10 this technical regulation of the Customs Union;

4. If the competent authorities of other Member States of the Customs Union protest against the said paragraph of this article 1 decision, the Commission of the Customs Union shall immediately consult with the competent authorities of all Member States of the Customs Union to adopt a mutually acceptable solution.
