TR TS 008 / 2011 SAFETY OF TOYS

foreword

1. This technical regulation of the Customs Union is developed in accordance with the Agreement on common principles and rules of technical regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation on November 18 2010 years.

2. This technical regulation of the Customs Union is designed to establish the common customs territory of the Customs Union unified mandatory for application and performance requirements for toys, ensuring the free movement of toys, put into circulation at the common customs territory of the Customs Union.

3. If in respect of toys will be taken other technical regulations of the Customs Union, the Eurasian Economic Community (hereinafter - EurAsEC) establishing requirements to toys, the toys should comply with the requirements of the technical regulations of the Customs Union, the Eurasian Economic Community, the action of which they are subject.

§ 1. Application area

1. This technical regulation of the Customs Union applies to put into circulation at the common customs territory of the Customs Union of toys that were not previously in use.

2. This technical regulation of the Customs Union shall not apply to products listed in 1 annex to the present technical regulations of the Customs Union, which are not considered as toys, as well as toys, custom tailored, exhibition samples.

3. This technical regulation of the Customs Union sets requirements for toys in order to protect the life and health of children and those looking after them as well as prevention of actions misleading purchasers (consumers) of toys regarding their purpose and security.

§ 2. define

In the present technical regulations of the Customs Union the following terms and their definitions:

  • ignition - The occurrence of burning under the influence of the source of ignition, accompanied by flames;
  • flammability - The ability of substances and materials in a fire;
  • playing kit containing chemical substances (not related to kits for chemical experiments) - Set for the production of plaster casts; ceramic materials and enamels for glass, supplied in sets for feature mini workshop equipment; kits comprising a moldable mass, based on plasticised PVC (followed by quenching in an oven); kits for art casting; Kits for pouring; kits for developing photographs; adhesive, paints, varnishes, thinners and cleaners (solvents), supplied in sets of design;
  • game set - A toy consisting of various items, materials, substances, designed to develop children's creativity and manual labor skills;
  • a toy - The product or material is intended for playing the child (ren) under the age of 14 years;
  • toy for water games - Toy (inflatable or non-inflatable), the load-bearing body weight of the child at swimming and (or) intended for games in shallow water;
    toys board-printing - Toy printing method performed with or without using additional game elements;
  • toy myagkonabivnaya - Toy with frame or without frame, with a soft surface and the filler;
  • toy model of the original - A toy whose dimensions are determined by a scale reduction in comparison with the real sizes of the inverse image;
  • manufacturer - A legal entity or natural person as an individual entrepreneur, carrying out on its behalf the production and sale of toys and are responsible for their compliance with the safety requirements of this technical regulation of the Customs Union;
  • importer - A resident of the Member State Customs Union, which concluded with a non-member state of the Customs Union agreement on the transfer of foreign toys, implements these toys and is responsible for their compliance with the safety requirements of this technical regulation of the Customs Union;
  • Design set - A set of mechanical and (or) electrical (electronic) components designed to build from it a variety of toys;
  • toy material - All materials that are part of the toy;
  • treatment of toys on the market - Transitions of toys from the manufacturer to the user (purchaser) in the common customs territory of the Customs Union, which takes place after the completion of its toy manufacturing;
  • optical toy - A toy, the principle of which is based on the use of the principles of geometrical optics;
  • user - A child using a toy on purpose, and the person to look after him;
  • the purchaser (consumer) - Natural or legal person who intends to purchase a toy or acquiring it;
  • intended use - The use of toys in accordance with its purpose specified by the manufacturer and on the toy (or) operational documents;
  • child - A person under the age of 14 years;
  • risk - A combination of the probability of harm and the consequences of this harm to the life and health of the child and the person looking after him;
  • typical sample toys - A toy chosen from a group of similar toys one age targeting (for children up to 3 years of 3 years and older) made one technical document workflow, from the same material and which are subject to the same safety requirements ;
  • person authorized by the manufacturer - Legal or natural person registered in the prescribed manner by the Member State Customs Union, which is defined by the manufacturer on the basis of a contract with him for action on behalf of a conformity assessment and placement of products on the single customs territory of the Customs Union, as well as for imposing liability for non-compliance Toys requirements of technical regulations of the Customs Union;
  • functional toys - Toy, which is a model used by older product or device that simulates the function and performance of its functions;
  • chemical toys - Set to conduct chemical experiments children, consisting of one or more chemicals and (or) reagents, supplied with the equipment or not;
  • electric toy - Toy, which at least one function is carried out by electrical energy.

§ 3. Handling on the market

1. Toys are issued on the market provided that they meet this technical regulation of the Customs Union, as well as other technical regulations of the Customs Union, the Eurasian Economic Community, the action of which they are subject, and provided that they have passed conformity assessment according to the article 6 of the present technical regulations of the Customs Union, as well as other technical regulations of the Customs Union, the Eurasian Economic Community, the action of which they are subject.

2. Toys, which match the requirements of the present technical regulations of the Customs Union has not been confirmed, must not be marked with a single sign of products on the market of the Member States of the Customs Union and are not allowed to be released into circulation in the market.

3. Toys are not labeled single sign of market of the Member States of the Customs Union, are not allowed to release into circulation on the market.

§ 4. Safety requirements

1. The toy should be designed and manufactured in such a way that when it is used as intended, it is not dangerous for life and health of children, and persons looking after them, and provided there is no risk:
due to design toys; due to the materials used;
associated with toys that can not be eliminated when modifying the toy without changing its function and basic characteristics of the replacement material.
The risk of using toys must relate to the age characteristics of children.

2. materials
The materials making up the toys must be clean (no dirt), uninfected, and meet the requirements of these technical regulations and standards specified in sub-paragraph article 1.2 5 this technical regulation of the Customs Union.
The toys for children up to 3 years is not allowed to use real fur, real leather, glass, porcelain, vorsovannoy rubber, paper and cardboard, the packing of granules of 3 mm or less without inner sheath, toys fillers such as rattles, whose size in a wet environment increases over 5%.
The toys for children up to 3 years old are not allowed migration of chemical substances 1-hazard class.
The toys are not allowed to use recycled materials resulting from the recycling of materials that were used. For the production of toys is allowed to use its own production waste.
Protective and decorative coating of toys must be resistant to wet processing, saliva and sweat.

3. Toys must be designed and constructed so that when used for its intended purpose, they do not represent a danger to life and health of children, persons looking after them.
3.1. Organoleptic
organoleptic hygienic safety of toys must meet the requirements set out in 2 annex to the present technical regulations of the Customs Union.

3.2. Physical and mechanical properties
Toy and its component parts, including fasteners, shall withstand the mechanical stresses resulting from the use of toys for other purposes, thus it must not break and must retain their consumer properties.
Accessible edges, sharp ends, rigid parts, springs, fasteners, gaps, edges, protrusions, cords, cables and fastenings toys should exclude a child's risk of injury.
Leakage of liquid-fill in toys is not allowed.
Moving components of toys shall avoid the risk of injury to children. Drivers should be available for children.
The toy and removable parts toys intended for children under the age of 3 years, as well as toys, directly fixed on foods should be sized to avoid falling into the upper respiratory tract.
Myagkonabivnaya toy should not contain a solid filler acute or foreign objects. Stitches myagkonabivnoy toys should be durable.
Toy, located in food and (or) entering the retail trade, together with the food must have their own packaging. The dimensions of the package should not cause a risk of choking child. Allowed outdoor seating without toys plastic packaging food packaging.
The toy and its components should exclude the risk associated with choking child. Masks and helmets for games of air-tight material, completely covering the child's head must be designed and constructed in such a way as to avoid the risk of suffocation as a result of inadequate ventilation.
The toy is designed for supporting the body of a child on the water must be designed and constructed so as to be airtight, strong.
The toy, which can fit inside a child and is a closed space for him, should have an opening to exit, easy to open from the inside and have a surface with vents.
A toy carrying the weight of a child and intended for driving should be strong and stable (except for two-wheeled bicycles). Toys with a mechanical or electric drive, having a free wheel mechanism or a neutral gearbox position, must have a braking device. Toys carrying the weight of the child's body and intended for driving, in which the movement of the wheel is reported directly by the hand or foot of the child or through a mechanical transmission and toys with an electric drive, can be manufactured without braking devices. Toys with chain transmission must be equipped with protective shields. The support surfaces must have anti-slip elements.
Toy, bearing the weight of the child and not for riding must be durable and resistant to rollover.
Toy with a projectile, produced with the help of a trigger, as well as having the kinetic energy of the projectile must minimize the risk of injury to the child, and (or) the person to look after him.
The designers and models to build children under the age of 10 years Soldering is not allowed.
Toy comprising heating elements must be made so as to ensure that:
the temperature of all available contact surfaces must not cause burns on contact;
level integrated infrared radiation flux intensity should correspond to the hygienic safety requirements specified in 2 annex to the present technical regulations of the Customs Union;
liquids, vapors or gases contained in the toy that the removal (if that removal is necessary for the functioning of toys) can cause burns or other injuries should not have elevated temperatures or pressures.
The level of local vibration in toys having a vibration source, the sound level must comply with the toys sounded hygienic safety requirements specified in 2 annex to the present technical regulations of the Customs Union.
Not allowed surface staining and painting toys, rattles and toys that come into contact with the mouth of the child.
The toys board-printed text and images must be clear and contrasting to the main background. Otmaryvanie inks on paper and cardboard is not allowed.
Optical toy must be designed and manufactured in such a way as to minimize the risk associated with the correction of a child.
Toys with LED should not have a negative effect on the organs of the child, cause harmful emissions.
The toys are prohibited the use of laser systems of all types.

3.3. flammability
Myagkonabivnye toys, costumes and carnival toy products (such as beards, mustaches, wigs, masks, crowns), as well as toys, where a child can be accommodated, must be fireproof.
Play set, comprising chemicals and not related to kits for chemical experiments should not contain materials or reagents, which can ignite when mixed and form harmful fumes or gases.
The toy should not be volatile or contain components (substances that material) which become explosive when using toys.
Toys, including toys chemical should not contain materials or reagents which: are capable of forming explosive mixtures in the reaction under heating, and in conjunction with oxidizing agents;
capable of forming a flammable or explosive mixture with air vapors.

3.4. Chemical properties
When using the toys need to minimize the risk of damage to health due to contact with chemicals in the respiratory tract, skin, mucous membranes, eyes or stomach.
The level of migration and the release of harmful chemicals from toys must meet the hygienic safety requirements specified in 2 annex to the present technical regulations of the Customs Union.
The chemical toys and play sets, including chemicals and not related to kits for chemical experiments, is allowed to use a certain number of substances or chemicals, if their content does not exceed the maximum amount set for each substance.

3.5. Toxicological and hygienic characteristics Toxicological and hygiene hygienic safety of toys must meet the performance requirements specified in 2 annex to the present technical regulations of the Customs Union.

3.6. Electrical properties
The electric toy, as well as on any of its component parts, the nominal voltage must not exceed 24 B.
Parts of toys that come into contact or are able to contact with a source of electrical energy, as well as cables, wires should be insulated and mechanically protected to avoid the risk of electric shock.
Levels of tension electrostatic, electromagnetic and electric fields of radio-controlled, electronic and electrical toys should meet the hygienic safety requirements specified in 2 annex to the present technical regulations of the Customs Union.
Cords for flying toys should be non-metallic.

3.7. Radiation safety
toys Radiation Safety Indicators (specific effective activity of natural radionuclides) made of natural materials, must comply with the hygienic safety requirements specified in 2 annex to the present technical regulations of the Customs Union.

3.8. microbiological indicators
Microbiological hygienic safety of toys must meet the performance requirements specified in 2 annex to the present technical regulations of the Customs Union.

4. Packaging
Packaging must be safe and eliminating the risk associated with choking child. The toy should be an individual and (or) packaging group.
If a package in which the toy is realized, as intended for use, it is considered as part of the toy. Scope packaging specified by the manufacturer.

5. Marking
5.1. Marking toys must be accurate, verifiable, clear, easy to read and accessible for inspection and identification.
5.2. Marking affixed by the manufacturer (person authorized by the manufacturer) and the importer.
Place and method of marking specified by the manufacturer (person authorized by the manufacturer) and the importer.

5.3. The marking shall include the following information:
- The name of the toy;
- Name of the country where the toy is made;
- The name and address of the manufacturer (the person authorized by the manufacturer), the importer, information to contact them;
- A trademark of the manufacturer (if available);
- The minimum age for a child for whom the toy is intended or an icon indicating the age of the child;
- The main structural material (for children up to 3 s) (if necessary).
- How to care for a toy (if necessary);
- The date of manufacture (month, year);
- Service life or shelf life (if installed);
- Storage conditions (if necessary).

5.4. Depending on the type of content marking toys include: completeness (for sets)
operating rules toys, methods of hygienic treatment, safety measures when handling the toy, warning labels, assembly instructions.
Warning information must contain an indication of the special precautions, when used in accordance with Annex 3 this technical regulation of the Customs Union.

6. Marking and technical documents supplied with the toy, are carried out on
Russian language and in the state (s) language (s) of the Customs Union member states in the presence of the relevant requirements of the law (s) state () term (s) of the Customs Union ..

§ 5. Ensuring compliance with safety requirements

1. Conformity of toys with this technical regulation of the Customs Union is provided by the implementation of:
1.1. hygienic safety requirements of this technical regulation of the Customs Union referred to in Annex 2 this technical regulation of the Customs Union;
1.2. safety requirements of this technical regulation of the Customs Union (except as specified in subparagraph 1.1 this paragraph) directly or standards requirements,
included in the list of standards, as a result of which, on a voluntary basis, compliance with the requirements of technical regulations of the Customs Union.
2. Research methods (test) set of toys in the standards included in the list of standards containing rules and research (testing) and measurement methods, including sampling rules, required for application and implementation of technical regulations
Customs Union and the implementation of evaluation (confirmation) of conformity.

§ 6. Confirmation of compliance

1. Before the release into circulation on the market of toys must undergo confirmation of compliance with safety requirements of this technical regulation of the Customs Union.
2. Conformity of toys made in the form of certification.
Certification is carried out by the certification body (conformity assessment (confirmation) of conformity), included in the Unified Register of certification bodies and testing laboratories (centers) of the Customs Union (hereinafter - the certification body) at certification schemes 1s, 2s, 3s in accordance with the Regulation on the application of standard assessment schemes (confirmation) of conformity to technical regulations of the Customs Union, approved by the Commission of the Customs Union (hereinafter - the Commission).
Tests for certification carries an accredited testing laboratory (center) included in the Unified Register of certification bodies and testing laboratories (centers) of the Customs Union (hereinafter - the accredited testing laboratory (center).
In the case of non-application of the standards referred to in subparagraph of Article 1.2 5 of the present technical regulations of the Customs Union, or in their absence, conformity assessment of toys is carried out in the form of certification (1s scheme, 2s, 3s) in accordance with paragraph of this article 5.
3. Certification of toys, mass-produced, is carried out under the schemes 1s, 2s. The selection of samples of toys for certification is carried out by the certification body or its authorized representative.
Certification is carried out by the party toys 3s scheme. Toy Party made in the common customs territory of the Customs Union, is a manufacturer, the lot of toys imported to the single customs territory of the Customs Union, is the importer or the person authorized by the manufacturer. The selection of samples of toys for certification is carried out by the certification body or its authorized representative.
4. During the certification of toys (1s scheme 2s, 3s):
4.1. manufacturer (manufacturer's authorized person), an importer provides the certification body a set of documents confirming the compliance of toys with safety requirements of this technical regulation of the Customs Union, which includes:
document on which the toy is made (1s circuit 2s); color image of the model (s) of the sample (s) toys;
a copy of the design documentation or technical description of the model (s) of the sample (s) toys; information on raw materials and components, information about their manufacturers and
importing (1s scheme 2s);
operational documents (if any);
list of standards, requirements of which must comply with toys from the list of standards referred to in subparagraph of Article 1.2 5 of the present technical regulations of the Customs Union (when they are used by the manufacturer);
certificate of conformity for toy production management system (2s scheme);
contract (supply contract) or shipping documentation (for a batch of toys) (3s scheme);
4.2. the certification body:
4.2.1. carries out the identification of toys;
4.2.2. organizes sample tests (samples) toys for compliance with standards from the List of standards referred to in subparagraph of Article 1.2 5 this technical regulation of the Customs Union, and conducts protocol analyzes (protocol) tests;
4.2.3. analyzes the state of production (1s scheme).
4.2.4. issue a certificate of compliance for a single form approved by the Commission.
The validity of the certificate of conformity for the toys, mass-produced - not more than 5 years, party toys for conformity certificate validity is not established;
4.3. manufacturer (manufacturer's authorized person), importer:
4.3.1. causing a single sign of products on the market of the Member States of the Customs Union;
4.3.2. forming after the completion of conformity set of documents for toys which includes:
documents referred to in subparagraph 4.1 of this paragraph; protocol (s) testing;
the results of analysis of production conditions (1s scheme); certificate of conformity.
4.4. the certification body:
carries out inspection control over certified toys by:
testing samples in an accredited testing laboratory (center) and (or) the analysis of production conditions (1s scheme);
testing samples in an accredited testing laboratory (center) and analysis of the results of inspection control by the certification body for management systems certified toy production management system (2s scheme).
5. During the certification of toys, in the case of non-application of standards from the List of standards referred to in subparagraph of Article 1.2 5 this technical regulation of the Customs Union, or in their absence (1s scheme, 2s, 3s):
5.1. manufacturer (manufacturer's authorized person), an importer provides the certification body a set of documents for toys, confirming that the toy safety requirements of this technical regulation of the Customs Union, which includes:
document on which the toy is made (1s circuit 2s); color image of the model (s) of the sample (s) toys;
a copy of the design documentation or technical description of the model (s) of the sample (s) toys; operational documents (if any);
information on raw materials and components, information about their manufacturers and importers (schemes 1s, 2s);
a description of the technical decisions and risk assessment confirming fulfillment of safety requirements of this technical regulation of the Customs Union;
certificate of conformity for toy production management system (2s scheme);
contract (supply contract) or shipping documentation (for a batch of toys) (3s scheme);
5.2. the certification body:
5.2.1. carries out the identification of toys;
5.2.2 carries toys certified directly the safety requirements of this technical regulation of the Customs Union.
This certification body:
determines, based on the security requirements of the present technical regulations of the Customs Union specific safety requirements for certified toys;
analyzes of the technical decisions and risk assessment confirming fulfillment of safety requirements of this technical regulation of the Customs Union of the manufacturer;
determines from the List of standards referred to in paragraph article 2 5 this technical regulation of the Customs Union, the standards setting research (test) methods, or in the absence thereof, determines the methods of control, measurements and tests to verify compliance with the specific requirements of safety of toys;
organizes and conducts tests of toys protocol analysis (protocols) tests;
5.2.3. analyzes the state of production (1s scheme);
5.2.4. issue a certificate of compliance for a single form approved by the Commission.
The validity of the certificate of conformity for the toys, mass-produced - not more than 5 years, party toys for conformity certificate validity is not established;
5.3. manufacturer (manufacturer's authorized person), importer:
5.3.1. causing a single sign of products on the market of the Member States of the Customs Union;
5.3.2. forming after the completion of conformity set of documents for toys which includes:
documents referred to in subparagraph 5.1 of this paragraph; protocol (s) testing;
the results of analysis of production conditions (1s scheme); certificate of conformity.
5.4. The certification body shall carry out inspection control over certified toys
by:
testing samples in an accredited testing laboratory (center) and (or) the analysis of production conditions (1s scheme);
testing samples in an accredited testing laboratory (center) and analysis of the results of inspection control by the certification body for management systems certified toy production management system (2s scheme).
6. A set of documents for toys must be kept on the territory of member states of the Customs Union on:
toys - from the manufacturer (person authorized by the manufacturer) for a minimum of 10 years from the date of withdrawal (termination) from the production of these toys;
party toy - the importer for at least 10 years from the date of implementation of the last articles of the party.

§ 7. Marking a single sign of products on the market of the Member States of the Customs Union

1. Toys complying with the security of the technical regulations of the Customs Union and the last confirmation of conformity under article 6 of the present technical regulations of the Customs Union shall be marked with a single sign of products on the market of the Member States of the Customs Union.

2. Marking a single sign of products on the market of the Member States of the Customs Union is carried out before the release of toys in circulation in the market.

3. A single sign of products on the market of the Member States of the Customs Union is applied directly on the toy itself and (or) packaging toy (individual, group, transportation) and (or) label, medallion, label (including the sewn label), package inserts, as well as given in the annexed operational documents.
A single sign of products on the market of the Member States of the Customs Union is applied in any manner that provides crisp and clear image throughout the life of the toy.
For toys consisting of several parts, a single sign of products on the market of the Member States of the Customs Union is applied to the parts that can be placed on the market separately.

4. Toys marked with a single sign of products on the market of the Member States of the Customs Union provided that they meet all the requirements of technical regulations of the Customs Union, the Eurasian Economic Community, the action of which they are subject, and provide for the application of the mark.

§ 8. Safeguard clause

The Member States of the Customs Union are obliged to take all measures to prohibit the release into circulation of toys within the common customs territory of the Customs Union, as well as the withdrawal from the market of toys that do not meet the safety requirements of this technical regulation of the Customs Union.

List of products that are not considered as toys and are not covered by the technical regulations of the Customs Union "On Safety of Toys" (TR CU 008 / 2011)

1. Christmas decorations, artificial Christmas trees and accessories, Electrogarlands.
2. Scale models for collectors, not intended for children under the age of 14 years.
3. Equipment for children's playgrounds.
4. Sports equipment, including underwater.
5. Folklore and decorative dolls not intended for children under the age of 14 years.
6. "Professional" toys installed in public places for public use.
7. Slot machines.
8. Puzzles with more than 500 details.
9. Airguns.
10. Catapults and devices for throwing.
11. Shells for throwing with metal tips.
12. Transformers for toys, powered by the network, chargers for batteries, including those provided with the toy.
13. Products containing heating elements intended for use in the educational process under adult supervision.
14. Vehicles intended for children under the age of 14 years, with internal combustion engines.
15. Toy cars with steam engines.
16. Bicycles designed for driving on public roads.
17. Games and toys, working at a nominal voltage of more than 24 B.
18. Replicas of firearms.
19. Jewelry for Children.
20. Accessories for diving (eg inflatable cuffs, worn on the hands).
21. Remedies (for swimming, sunglasses, bicycle helmets, skateboard helmets).
22. Flying toys that run a child with a rubber cord.
23. Luke shooting of a length in a loose state exceeds 1200 mm.
24. Sanitary products made of latex, rubber and silicone elastomers for children.

2 Annex to the technical regulations of the Customs Union "On Safety of Toys" (TR CU 008 / 2011)

hygienic toy safety requirements in accordance with the technical regulations of the Customs Union "On Safety of Toys" (TR CU 008 / 2011)

1. hygienic toy safety requirements include: organoleptic (smell, taste);
Physical factors (sound level, the level of electrostatic field strength, the level of intensity of the electromagnetic field of radio-frequency range, the level of the electric field, the intensity level of the integrated flux of infrared radiation, the level of local vibration, specific effective activity of natural radionuclides);
sanitary-chemical indicators (migration modeling environment to hazardous chemicals, the list of which is determined by the chemical composition of the material, and the rules of allocation of harmful chemicals from toys);
Toxicological-hygienic characteristics (irritant effect on mucous membranes, toxicity index); microbiological indicators.
If the hygienic safety confirmation detected mismatch toys to any of the monitored parameters, it is recognized as inappropriate, and further studies are terminated.
2. Organoleptic
2.1. The intensity of the odor toys in vivo and aqueous extract should not exceed 1 points in toys intended for children up to the year 1, 2 points - for children over 1 years. The intensity of the odor of the sample and aqueous extracts of toys for children over 3 years should not exceed 2 points.
2.2. Toys intended for children up to 3 years, and toys that come into contact with the oral cavity, should not have a flavor intensity over 1 points.
3. Physical factors
3.1. Sounding toys must meet the following requirements:
The equivalent level of sound toys, except toy models for sports games should be: for children up to 3 years - no more than 60 dBA;
for children up to 3 6 years - no more than 65 dBA; for children over 6 years - no more than 70 dBA.
Equivalent sound level of toys for outdoor games, in addition to toys, publishing sound pulse should be no more than 75 dBA.
The maximum sound level of toys should be: for children up to 3 years - no more than 70 dBA;
for children up to 3 6 years - no more than 75 dBA; for children over 6 years - no more than 80 dBA.
The maximum sound level of toys for outdoor games should be no more than 85 dBA.
The maximum sound level of toys, publishing sound pulse should be no more than 90 dBA.
