foreword

1. This technical regulation is designed in accordance with the Agreement on common principles and rules of technical regulation in the Republic of Belarus, Kazakhstan and the Russian Federation of November 18 2010 city

2. This technical regulation is designed to establish the common customs territory of the Customs Union of uniform mandatory for the application and enforcement of the requirements for the machines and (or) equipment in the development (design), manufacture, installation, commissioning, operation, storage, transportation, marketing and utilization, ensure the free movement of vehicles and (or) equipment put into circulation in the common customs territory of the Customs Union.

3. If, in respect of machines and (or) equipment will be accepted other technical regulations of the Customs Union, the technical regulations of the Eurasian Economic Community (hereinafter - EEC) establishing requirements for machines and (or) equipment, the machines and (or) equipment shall meet the requirements of these technical regulations of the Customs Union, EurAsEC action which they are subject.

§ 1. Application area

1. This technical regulation applies to machines and (or) equipment manufactured in circulation at the common customs territory of the Customs Union.

2. This technical regulation establishes the minimum requirements of security machines and (or) equipment in the development (design), manufacture, installation, commissioning, operation, storage, transportation, marketing and utilization in order to protect human life or health, property, environment, life and animal health, prevention of actions misleading consumers.

3. This technical regulation applies to machines and (or) equipment, which were revealed and identified hazards, requirements for removal or reduction are established in accordance with Annexes № 1 and № 2.

4. This technical regulation does not apply to the following types of machines and (or) equipment:
- Machines and (or) equipment related to ensuring the integrity and sustainability of the networks and the radio frequency spectrum;
- Machines and (or) equipment used for medical purposes and used in direct contact with the patient (X-ray, diagnostic, therapeutic, orthopedic, dental, surgical equipment);
- Machines and (or) equipment specifically designed for use in the field of nuclear energy. Machinery and (or) equipment for general industrial use, applied in the field of nuclear energy, the effect of these technical regulations apply to the extent not inconsistent with the requirements for nuclear and radiation safety;
- Wheeled vehicles, other than those stated on their machines and (or) equipment;
- Sea and river transport vehicles (ships and craft, including those used for their machines and (or) equipment);
- Aircraft and spacecraft;
- Railway rolling stock and technical tools that are specifically designed for use on rail and underground;
- Attractions;
- Weapons and military equipment;
- Machines and (or) equipment intended for use by persons with disabilities;
- Agricultural and forestry tractors and trailers, other than those stated on their machines and (or) equipment;
- Drilling platforms, except those used for their machines and (or) equipment.

5. The present technical regulation applies to machines and (or) equipment used at hazardous production facilities.

6. If the risks posed by machines, and (or) equipment, fully or partially installed in other technical regulations of the Customs Union, the Eurasian Economic Community, the machines and (or) equipment shall meet the requirements of technical regulations of the Customs Union, the Eurasian Economic Community, the action of which they are subject.

7. When identifying the machines and (or) equipment are mapping specific machines and (or) equipment sample or description as that may be used standards referred to in paragraph 1 6 articles of these technical regulations, classifications, specifications and drawings, specifications, operational documentation.

8. Additional safety requirements for certain categories of machinery and equipment installed in accordance with Annex № 2.

§ 2. define

1. This technical regulation, the following terms and their definitions:
Avari- The destruction of or damage to the machine and (or) equipment, the development of the operation of machines and (or) equipment uncontrolled explosion and (or) release of hazardous and noxious substances;
tolerable risk- Significance of the risk from the use of machines and (or) equipment, based on the technical and economic possibilities of the manufacturer, the appropriate level of security to be maintained at all stages of the product life cycle;
life cycle- The period of time from the initial design and the machine (or) until the completion of recycling equipment, including interlinked stages (design, manufacture, storage, installation, commissioning, operation, including reconstruction, repair, maintenance and service);
incident- Refusal machines and (or) equipment, deviation from process conditions;
critical failure- Refusal machines and (or) equipment, the possible consequences of which is causing harm to life or health, property, the environment, life and health of animals and plants;
machine- A series of interconnected parts or components, of which at least one part or one node moves with the appropriate actuators, control circuits, power sources, grouped together for a specific application (eg, handling, processing, handling or packaging material);
mobile power tools- Tractors, universal energy resources Motor vehicle chassis;
assigned resource- The total time above which the operation of the machine and (or) equipment must be stopped regardless of their technical condition;
working hours- The duration or extent of the machine and (or) equipment;
specified lifetime- Calendar duration of the operation of the machine and (or) equipment, above which the operation is to be terminated, regardless of their technical condition;
appointed term storage- Calendar duration of storage machines and (or) equipment, which upon reaching their storage must be terminated, regardless of their technical condition;
Intended use of the machine- The use of machines and (or) equipment in accordance with the purpose specified by the manufacturer in the operating documents;
safety justification- A document containing an analysis of risk, as well as details of the design, operation, technical documentation about the minimum required safety measures accompanying the machine and (or) equipment for all stages of the life cycle and is supplemented by information on the results of risk assessment at the stage after a major operation repair;
equipment- Used alone or installed on the machine technical apparatus necessary to carry out its core and (or) additional functions, as well as to merge multiple machines into a single system;
failure- An event that is in violation of a healthy state machines and (or) equipment as a result of structural violations in the design, non-established process of manufacture or repair of default rules or guidelines (instructions) for use;
limit state- State machines and (or) equipment where their continued operation is invalid or impractical or restore their healthy state impossible or impractical;
connectable machine- Mobile, trailers, semi-trailer, mounted, semi-mounted or mounted on mobile energy means a machine designed to perform operations on the production and primary processing of agricultural products, etc.;
developer (designer) - Legal or natural person performing the process of creating a new type of machinery and equipment, development of technical documentation for the prototype and manufacture of a prototype;
developer (designer) system- Legal or natural person performing the process of creating the project documentation for the machine system and (or) equipment (production lines, related production cycle);
farm tractor units- Complex, which is a combination of a mobile power tools with trailer, semi-trailer or mounted machine (or machines), and intended to provide technological agricultural operations;
system- A set of machines and (or) of the equipment, combined structurally and (or) for operatively performing the required functions;
danger- A potential source of harm to human life and health, property and environment;
danger zone- Space in which human exposures danger emanating from the machine or equipment;
risk- A combination of probability of harm and consequences of harm to human life or health, property, the environment, human life or health of animals and plants.

§ 3. Handling on the market

1. Machinery and (or) equipment shall be issued in the market that they meet these Technical Regulations, and other technical regulations of the Customs Union, the Eurasian Economic Community, the action of which they are subject, and provided that they have passed conformity assessment procedures set out in this technical regulations, and well as other technical regulations of the Customs Union, the Eurasian Economic Community, the action of which they are subject.
Machinery and (or) equipment, which conformity requirements hereof not checked, no one should be marked with a mark of products on the market of the Member States of the Customs Union and not allowed to be released into circulation in the common customs territory of the Customs Union.

Article 4. Ensuring the safety of machines and (or) equipment in the development (design)

1. In the development (design) of the machine and (or) equipment must be identified possible hazards at all stages of the life cycle.

2. For the identified hazards should be carried out a risk assessment calculations, experimental, or by an expert according to operation of similar machines and (or) equipment. Risk assessment techniques can be installed in the standards referred to in paragraph article 1 6 these Technical Regulations.

3. When designing (design) should be determined and set acceptable risk for the machine and (or) equipment. The level of security appropriate to the identified risks, is provided:
- Completeness of the research and development activities;
- Carrying out the necessary calculations and complex tests, based on verified in the prescribed manner techniques;
- The choice of materials and substances used in certain types of machines and (or) equipment, depending on the parameters and operating conditions;
- Establishment of a developer (designer) criteria limit states;
- Establishment of a developer (designer) Service life, assigned resources, timing of maintenance, repair and disposal.
- Identifying all hazards associated with the possible misuse predictable machines and (or) equipment;
-Limitation in the use of machines and (or) equipment.

4. If the estimated risk is higher allowable, to reduce it must be changed and the project car (or) equipment, without the intervention of personnel in all operating modes of the machine and (or) equipment (if intervention is not provided guidance (instruction) manual).

5. When it is impossible to achieve the technical characteristics of the machine and (or) equipment, determining acceptable risk, by changing the project, as well as uneconomic in the user manual (instruction) manual contains information that limits the conditions of use of this machine, and (or) equipment or the need for caution security measures.

6. In developing (designing) machines and (or) equipment must be installed levels of physical factors (noise, infrasound, air and contact ultrasound, local and whole-body vibration, electromagnetic fields), and the emission levels of hazardous and noxious substances, to ensure the safety of their operation .

7. In developing (designing) machines and (or) equipment must be designed safety justification.
Original of the safety of machines and (or) equipment stored at the developer (designer), and a copy - the manufacturer of machines and (or) equipment and the organization operating the machines and (or) equipment.

8. Development of guidelines (instructions) manual is an integral part of the development (design) of the machine, and (or) equipment. Manual (user) manual includes:
- Information on the design, principle of operation, characteristics (properties) of machinery and / or equipment;
- Instructions for installation or assembly, setup or adjustment, maintenance and repair of machines and (or) equipment;
- Instructions for using the machine, and (or) equipment and safety measures that must be taken when using the machine, and (or) equipment, including commissioning, intended use, maintenance, repair of all kinds, periodic diagnostics, testing, transportation , packaging, preservation and storage conditions;
- Assigned values ​​(designated shelf life specified lifetime and (or) the assigned resource) depending on the design features. At the end of the designated indicators (assigned resource shelf life, life) vehicle and (or) equipment removed from service, and a decision about the direction of their repair, about recycling, check and establishing new designated indicators (assigned resource shelf life , lifetime);
- A list of critical failures, possible false operations which lead to an incident or accident;
- Personnel actions in the event of an incident, accident or critical failure;
- Criteria limit states;
- Instructions for decommissioning and disposal.
- Information on the qualifications of the staff.

9. If the machine and (or) equipment intended for use not professional users guide (manual) for use shall take into account the knowledge, skill and experience of such users.

Article 5. Ensuring the safety of machines and (or) equipment in the manufacture, storage, transportation, use and disposal

1. In the manufacture of machines and (or) equipment must be ensured that they meet the design (design) documentation and these Technical Regulations.

2. In the manufacture of machines and (or) equipment manufacturer must perform the full range of security measures, a certain project (design) documentation, they must also be capable of monitoring the implementation of all technological operations that affect security.

3. In the manufacture of machines and (or) equipment must be carried out tests specified project (design) documentation.

4. In the manufacture of machines and (or) equipment must be provided with safety requirements established by the project (design) documentation in accordance with the technical regulations, subject to the applicable processes and control systems. Manufactured by conducting a risk assessment of machinery and (or) equipment before release into circulation.

5. Deviations from the project (design) documentation in the manufacture of machines and (or) equipment should be coordinated with the developer (designer). Risk from the use of machines and (or) equipment manufactured according to the agreed project (design) documentation should not be higher than acceptable risk set by the developer (designer).

6. Machine manufacturer and (or) equipment must provide machines and (or) equipment guidance (instruction) manual.

7. Machine and (or) equipment shall be clearly legible and indelible warning labels or signs on hazards.

8. Machine and (or) equipment shall be well distinguished clearly and indelibly identification label containing:
- The manufacturer's name and (or) its trademark;
- Name and (or) Designation of the machine and (or) equipment (type, make, model (if any));
- Month and year of manufacture.

9. If the information listed in paragraph 8 this article, it is impossible to put on the car and (or) equipment, they can only be specified in the attached to this machine and (or) hardware manual (instruction) manual. In this case the manufacturer's name and (or) its trademark name and designation of the machine and (or) equipment (type, make, model (if any)) shall be marked on the packaging.

10. The information referred to in paragraph 8 this article should be in the manual (instruction) manual. In addition, management (user) manual must contain the name and address of the manufacturer (person authorized by the manufacturer), importer, information to contact them.

11. The operating manual (instruction) is executed in Russian and in the state language (s) of the Member State of the Customs Union, if there are relevant requirements in the legislation (s) of the state (s) - the member (s) of the Customs Union. Manual (instruction) for operation is carried out on paper. A set of operational documents on electronic carriers can be attached to it. The operating manual (instruction) included in the set of the machine and (or) non-household equipment, at the choice of the manufacturer, can be performed only on electronic media.

12. Materials and substances used for packing machines and (or) equipment should be safe.

13. Transportation and storage machines and (or) equipment, their components and parts must be subject to the requirements of security, provided the project (design) and operational documentation.

14. During maintenance, repair and inspection machines and (or) equipment must comply with the requirements set at the top (instruction) manual, program maintenance or repair for the duration of these works.

15. Changes to the machine, and (or) equipment arising from their repair must be agreed with the developer (designer).

16. After overhaul machines and (or) equipment must be carried out a risk assessment, whose value should not be higher than the permissible. If necessary, developed technical and organizational measures to achieve acceptable risk values.

17. For refurbished machines and (or) equipment that does not meet the design (design) documentation should be developed to ensure the measures established in the safety risk values ​​taking into account the adopted technological processes and control systems.

18. The manual (instructions) for use shall be established guidelines for the safe disposal of the machine and (or) equipment.

19. When designing machines and (or) equipment in the user manual (instruction) manual must be defined measures to prevent misuse of the machine and (or) equipment after the assigned resource or design life.

§ 6. Ensuring compliance with safety requirements

Match machines and (or) equipment this technical regulation is ensured by the requirements of its directly or compliance with the requirements of interstate standards, and in their absence (before the adoption of interstate standards) - the national (state) standards of the Member States of the Customs Union, as a result of which, on a voluntary basis, compliance with
technical regulations of the Customs Union and standards containing rules and methods (tests) and measurements, including the rules of sampling required for the application and enforcement of the requirements of this technical regulation of the Customs Union and the implementation of the evaluation (confirmation) of compliance products (hereinafter - the standards) the relevant machinery and (or) equipment.
Voluntary performance requirements of these standards indicates compliance of machines and (or) equipment safety requirements of this Technical Regulation.

Article 7. Conformity Assessment

1. Machinery and (or) equipment put into circulation in the common customs territory of the Customs Union, subject to conformity assessment requirements hereof.
Conformity assessment requirements hereof is held in the form of conformity in the form of state control (supervision).
Machinery and (or) used equipment, or made for the needs of their own manufacturers, as well as components and spare parts for machines used for repair (maintenance) machines and (or) equipment not subject to conformity assessment requirements of this technical Regulations.

§ 8. Confirmation of compliance

1. Demonstration of compliance with machines and (or) equipment shall be in accordance with standardized procedures approved by the Commission of the Customs Union.

2. Demonstration of compliance with machines and (or) equipment requirements hereof shall take the form:
certification by an accredited certification body (assessment (confirmation)) (hereinafter - the certification body), included in the Unified Register of certification bodies and testing laboratories (centers) of the Customs Union;
declaration of conformity based on their own evidence, and (or) obtained with the participation of the certification body or an accredited testing laboratory (center) included in the Unified Register of certification bodies and testing laboratories (centers) of the Customs Union (hereinafter - accredited testing laboratory (center)).

3. Certification is carried out in respect of machines and (or) equipment included in the list of objects of technical regulation, subject to conformity with the technical regulations of the Customs Union "On the security of machinery and equipment" in the form of certification annexed № 3.

4. Declaration of conformity carried out by the applicant in respect of machines and (or) equipment included in the list of objects of technical regulation, subject to conformity with the technical regulations of the Customs Union "On the security of machinery and equipment" in the form of declaration of conformity set out in Annex
№ 3.

5. By decision of the applicant instead of the declaration of conformity in relation to machines and (or) equipment included in the list referred to in paragraph 1 4 paragraph of this Article may be carried out certification certification schemes equivalent circuits declaration of conformity provided for machines and (or) present technical equipment regulations, including the absence or failure of the applicant's own evidence of conformity requirements hereof.

6. Declaration of conformity or the certificate of conformity is the only document that confirms that the machine and (or) equipment requirements hereof.

7. The declaration of conformity and certificate of conformity shall have equal legal force and take effect in the common customs territory of the Customs Union in relation to machines and (or) equipment put into circulation in the common customs territory of the Customs Union at the time of the declaration of conformity or the certificate of conformity, and with respect to each unit (car and (or) equipment), during her lifetime.

8. Information about the declaration of conformity or the certificate of conformity must be specified in the passport machines and (or) equipment.

9. In carrying out conformity verified and machines and (or) equipment requirements hereof specified directly, or set forth in the standards referred to in Article 6 these Technical Regulations.

10. In carrying out conformity assessment of machinery and (or) equipment applicant generates a set of documents on the machine and (or) equipment, confirming compliance with the safety requirements of these technical regulations, which includes:

safety justification, technical conditions (if any); operational documents;
a list of the standards referred to in Article 6, which shall conform to the requirements of these machines and (or) equipment (when used by the manufacturer);
contract (supply contract) (for the party, a single product), or shipping documentation (for the party, a single product);
certificate management system manufacturer (if available); information on the studies (if available);
machine testing protocols and (or) equipment of the manufacturer, the seller or person executing functions of the foreign manufacturer, and (or) test laboratories (centers) (if available);
certificates of compliance for materials and components or their testing protocols (if any);
certificates of conformity for these machines and (or) equipment from foreign certification bodies (if any);
other documents directly or indirectly confirming that the machines and (or) equipment safety requirements of these technical regulations (if any).

Article 9. Procedure declaration of conformity of machinery and (or) equipment

Declaration of conformity of machines and (or) equipment provided by the schemes:

1d scheme - for standard production machines and (or) equipment includes the following steps:
applicant generates a set of documents referred to in paragraph article 10 8; provides production control and take all necessary measures to ensure that the manufacturing process ensures compliance of machines and (or) equipment requirements hereof, conducts tests on samples of the test laboratory or an accredited testing laboratory ( center), receives and records the declaration of conformity.

2d scheme - for the party machines and (or) equipment (a single product) includes the following steps:
applicant generates a set of documents referred to in paragraph article 10 8;

is testing samples in an accredited testing laboratory or
testing laboratory (center), receives and records the declaration of conformity.

3d scheme - for standard production machines and (or) equipment includes the following steps:
applicant generates a set of documents referred to in paragraph article 10 8; provides production control and take all necessary measures to ensure that the manufacturing process ensures compliance of machines and (or) equipment requirements hereof, conducts tests on samples in accredited testing laboratory (center) receives and records the declaration of conformity.

4d scheme - for the party machines and (or) equipment (a single product) includes the following steps:
applicant generates a set of documents referred to in paragraph article 10 8; conducts tests on samples in accredited testing laboratory (center), receives and records the declaration of conformity;

5d scheme - used machines and (or) equipment used at hazardous production facilities;
if you can not test in full prior to their installation on site;
when the applicant upon confirmation of conformity does not apply the standards referred to in paragraph 1 6 articles of these technical regulations, including for product innovation.
Includes the following steps:

applicant generates a set of documents referred to in paragraph article 10 8; provides production control and take all necessary measures to ensure that the manufacturing process ensures compliance of machines and (or) equipment requirements hereof and directs the certification application for the type of research;
certification body conducts research in light of the type of applicant's documents. If the applicant has not applied the standards referred to in paragraph 1 6 articles of these technical regulations, the certification body assesses the possibility of replacing the requirements of these standards stated requirements. Study types depending on documents submitted by the applicant, conducted by one of the following ways:
Study samples as representative of all subsequently produced machines and (or) of the equipment;
study of the documents submitted, the test sample or determining the (critical) parts of machines and (or) equipment;
With positive results of conducted studies such as the certification body draws up a certificate for the type in a single form approved by the Commission's decision and issues it to the applicant. The type certificate is an integral part of the declaration of conformity and the claimed requirements to the machine and (or) equipment recognized as sufficient evidence of compliance with its requirements are used in inspections conducted by the state control (supervision) authorities for compliance with this technical regulation ;
applicant receives and records the declaration of conformity.

6d scheme - for standard production machines and (or) in the presence of equipment manufacturer certified management system includes the following steps:
applicant generates a set of documents referred to in paragraph article 10 8, which is included in the certificate management system (copy of the certificate of conformity) issued by the certification of management systems included in the Unified Register of certification bodies and testing laboratories (centers) of the Customs Union; carries production control and take all necessary measures to ensure that the manufacturing process ensures compliance of machines and (or) equipment
requirements hereof, conducts tests on samples in accredited testing laboratory (center), receives and records the declaration of conformity.

When declaring compliance according to the schemes 1d, 3d, 5d, 6, the applicant may be a legal entity or individual registered in accordance with the legislation of the Member State of the Customs Union in its territory as an individual entrepreneur or a manufacturer or performing the functions of a foreign manufacturer on the basis of Contract with him, in terms of ensuring the compliance of the supplied products with the requirements of this technical regulation and with regard to liability for non-compliance stavlyaemoy products with the requirements of this technical regulation of the Customs Union (the person performing the functions of the foreign manufacturer).

When declaring compliance according to the schemes 2d, 4d, the applicant may be a legal entity or individual registered in accordance with the legislation of the Member State of the Customs Union in its territory as an individual entrepreneur or a manufacturer or seller or acting as a foreign manufacturer on the basis of an agreement with In the part of ensuring compliance of the supplied products with the requirements of this technical regulation and with regard to liability for non-compliance Of the supplied products to the requirements of this technical regulation of the Customs Union (a person performing the functions of a foreign manufacturer).

Article 10. Composition of the evidentiary materials that are the basis for the declaration of conformity

1. As evidentiary materials that are the basis for the declaration on the basis of his own evidence, used the documents referred to in paragraph article 10 8 these technical regulations and standards referred to in Article 6 these Technical Regulations.

2. As conditions for the application of these documents can be considered:
1) for test reports:
presence in the test values ​​of the indicators confirming compliance with all the requirements specified in these Technical Regulations, applies to specific products declared;
dissemination of the testing machine and claimed (or) equipment;
2) certificates of conformity, declaration of conformity or test reports for raw materials, components - if they determine the safety of the final product to be conformity;
3) certificates for quality management system of production - if they apply to the manufacture of machinery and claimed (or) equipment;
4) other documents directly or indirectly confirming that the machines and (or) equipment to the requirements, certificates of conformity for machinery and claimed (or) equipment issued under voluntary certification (provided that the voluntary certification confirmed all the necessary requirements).

3. Declaration of Conformity issued by a single form, approved by the decision of the Commission of the Customs Union.
The declaration of conformity shall be registered in accordance with the procedure approved by the Customs Union Commission. The declaration of conformity starts from the day of registration. Validity of the declaration of conformity - no more 5 years.

4. The applicant shall keep the declaration of conformity and the evidentiary materials for ten years from the date of expiry of the declaration of conformity.
Set of documents proving compliance should be granted bodies of state control (supervision) in their requirements.

Article 11. Procedure for certification of machines and (or) equipment

1. Certification of machines and (or) equipment provided by the schemes:

1s scheme - for standard production machines and (or) equipment includes the following: the applicant generates a set of documents referred to in paragraph 10 8 articles and submit an application for certification of the certification body;
certification body carries out sampling of the applicant to perform the tests;
accredited testing laboratory (center), listed in the Unified Register of certification bodies and testing laboratories (centers) of the Customs Union (hereinafter - accredited testing laboratory (center)) is testing samples of machines and (or) equipment;
certification body conducts analysis of the production of the manufacturer and the results of sample testing machines and (or) equipment and positive results gives the applicant a certificate of conformity;
certification body conducts inspection control of certified machines, and (or) equipment by testing samples in an accredited testing laboratory (center) and (or) analysis of production.

3s scheme - for the party machines and (or) equipment (a single product) includes the following steps:
applicant generates a set of documents referred to in paragraph 10 8 articles and submit an application for certification of the certification body;
certification body or accredited testing laboratory (center) carries out sampling of the applicant to perform the tests;
accredited testing laboratory (center), is testing samples of machines and (or) equipment;
certification body analyzes the results of sample testing machines and (or) equipment and positive results gives the applicant a certificate of conformity;

9s scheme - for the party machines and (or) the limited amount of equipment, designed to equip enterprises in the same territory of the Customs Union, comprising the following steps:
applicant generates a set of documents referred to in paragraph 10 8 articles and submit an application for certification of the certification body;
certification body analyzes submitted by the applicant and a set of documents with the positive results of issue to the applicant a certificate of conformity.
The applicant for certification under schemes 1c, 9c may be a legal entity or individual registered in accordance with the legislation of the Member State of the Customs Union in its territory as an individual entrepreneur or a manufacturer or performing the functions of a foreign manufacturer on the basis of an agreement with him, in part Ensuring compliance of the supplied products with the requirements of this technical regulation and with regard to the responsibility for the nonconformity of the supplied products IAOD this technical regulation of the Customs Union (the person performing the functions of the foreign manufacturer).
Applicant for the certification scheme 3s be registered in accordance with the legislation of the Member State of the Customs Union on its territory a legal entity or natural person as an individual entrepreneur, or being the manufacturer or seller, or performing the functions of the foreign manufacturer under a contract with him, in part ensure compliance of products supplied requirements hereof and of the responsibility for non-
supplied products to the requirements of the technical regulations of the Customs Union (person performing the functions of the foreign manufacturer).

2. The applicant may request an application for certification in any certification body having Accreditation machines and (or) equipment included in the list of machinery and equipment, subject to conformity with the technical regulations of the Customs Union
"On the safety of machinery and equipment" in the form of certification approved by the Customs Union Commission.
The application for certification is made by the applicant and shall contain:
Name and address of applicant, name and address of the manufacturer;
information about the car and (or) equipment (its structure) and its identifying characteristics (name, code Classifier for Foreign Economic Activity of the Customs Union, the document on which the machine is made and (or) equipment (interstate or national standard, enterprise standard, specifications and etc.), the form of - mass production or party, details of the agreement (contract), etc.);
use (s), standard (s) referred to in paragraph 1 6 articles of this technical regulation;
certification scheme.

3. The certification body shall consider the application and make a decision on the certification.
If approved certification body enters into a contract with the applicant for certification works.
The certification body conducts work under the certification scheme, and preparing a decision with a positive result shall issue a certificate of conformity.

4. In case of a negative certification certification body sends the applicant a reasoned decision to refuse to issue a certificate of conformity.

5. Model test (type specimens) or a single product machines and (or) equipment conducted by accredited testing laboratory (center) on behalf of the certification authority which issued the test report.

6. Analysis of production carried out by a certification from the manufacturer. Results of the analysis are drawn act.
In the presence of the manufacturer's certified quality management system production or development and production of machines and (or) equipment certification body assesses the possibility of the system to ensure stable output of certified machines and (or) equipment conforming to these technical regulations.

7. With positive results of the checks provided by the certification scheme, the certification body draws up a certificate of conformity, and outputs it to the applicant.
Certificate of conformity issued by a single form, approved by the decision of the Commission of the Customs Union.
Information on the certificate of conformity issued by the certification body sends to the Unified Register of issued certificates of conformity and registered declarations of conformity issued by a single form.

8. Validity of the certificate of conformity of the machinery established for and (or) equipment serial production - no more 5 years, for a period batch is not set.

9. Certificate of compliance may have an application that contains a list of specific products for which it applies.
Application is made if:

required to detail the group of similar products manufactured by the applicant and certified by the same requirements;
you must specify the manufacturers included in the larger units having uniform conditions of production.

Article 12. Marking a single sign of products on the market of the Member States of the Customs Union

1. Machinery and (or) equipment conforming
safety of these technical regulations and conformity assessment procedures past under Article 8 these technical regulations, shall be marked with a mark of a single product on the market of the Member States of the Customs Union.

2. Marking a single sign of products on the market of the Customs Union member states is carried out before the release of machines and (or) equipment in circulation in the market.

3. Single sign of products on the market of the Customs Union member states is applied to each unit of machinery and (or) equipment in any way, providing crisp and clear images for the entire life of the machine and (or) equipment.
Single sign of products on the market of the Customs Union member states to apply the product itself.

4. May be applied as a single mark of products on the market of the Member States of the Customs Union only on the packaging and accompanying operational documents, if it can not be applied directly to the machine, and (or) equipment.

5. Machinery and (or) equipment marked with a mark of one product on the market of the Customs Union member states in their compliance with all technical regulations of the Customs Union, the Eurasian Economic Community,
applicable to them and providing for the application of a single mark of products on the market of the Member States of the Customs Union.

§ 13. Safeguard clause

1. Member States of the Customs Union shall take all measures to control, prohibition of issue machines and (or) equipment in the common customs territory of the Customs Union, and withdrawal from the market of machines and (or) equipment not complying with the requirements hereof.

Annex № 1 to Technical Regulations of the Customs Union "On the safety of machinery and equipment" (TR CU 010 / 2011)

BASIC SAFETY VEHICLES AND (OR) EQUIPMENT

1. Must be capable of carrying out adjustment and maintenance machines and (or) equipment without exposing personnel hazard under the conditions provided by the manufacturer.

2. When designing (design) and manufacturing machines and (or) equipment responsible person must:
eliminate or reduce a hazard to take action to protect from danger;
inform consumers about protective measures, indicate whether special training, and determine the need for technological protection measures.

3. When designing (design) and manufacturing machines and (or) equipment, as well as in the development of guidance (instructions) for machine operation and (or) equipment should be tolerable risk in the operation of machines and (or) equipment.

4. If as a result of an invalid operation may be a risk, machine design and (or) equipment should prevent such exploitation. If this is not possible, in the user manual (instruction) manual addresses the consumer's attention to such situations.

5. When designing (design) and manufacturing machines and (or) the equipment necessary to use ergonomic principles to reduce the influence of discomfort, fatigue and psychological stress of staff to the lowest possible level.

6. When designing (design) and manufacturing machines and (or) equipment should be considered limitations on the actions of the operator when using PPE.

7. Machine and (or) equipment must be staffed in accordance with the instruction manual necessary devices and tools for the safe adjustments, maintenance, and intended use.

8. Machine and (or) equipment should be developed (projected) and constructed so that the raw materials and substances used in their manufacture and operation, do not threaten the safety of life or health, property, the environment, health or life of animals.
When using liquids and gases should be excluded hazards associated with their use.

9. Provide extra lighting for safe machine operation and (or) equipment.
Internal parts of the machine and the area and (or) equipment requiring frequent inspection, adjustment and maintenance, should have lighting that provides safety.
When operating the machine, and (or) equipment necessary to avoid the formation of shaded areas, areas subject to interference, and blinding strobe effect.

10. Machine and (or) or equipment, each of them must be packaged so that they can be stored safely and without damage, having a sufficient stability.

11. If the weight, size or shape of the car, and (or), or their various equipment pieces can not move them by hand, machine, and (or) or equipment, each of them must:
devices equipped with a mechanism for lifting, having a configuration to be able to apply standard lifting equipment.

12. In case the machine and (or) or one of the equipment parts to be moved by hand, they are easy to move, or should be equipped with means for lifting.
There should be a special place for the safe disposal of instruments parts and components required for operation.

13. Machine control system and (or) equipment must ensure the safety of their operation in all modes of operation and provided for all external actions envisaged operating conditions.
Control system should prevent the development of dangerous situations when possible and logical errors due to violations of personnel control actions.
Depending on the complexity of management and control mode of operation of machines and (or) equipment management system should include means of automatic control modes or means of an automatic stop if the abnormality can cause dangerous situation.

14. Machine control system and (or) equipment must include a means warning and other means to warn of violations machine functioning and (or) equipment, leading to dangerous situations.
Aids warning of disruption of the functioning of machines and (or) equipment must ensure flawless, accurate and prompt information perception staff.

15. Machine controls and (or) equipment must be: easily accessible and freely distinguishable provided with inscriptions or symbols are marked in other ways;
constructed and arranged so as to prevent their involuntary movement and provides a reliable, confident and unambiguous manipulation;
accommodated, taking into account the effort required to move, consistency and frequency of use, as well as the importance of the functions;
configured so that their shape and size correspond to the capture method (finger, brush), or pressing (thumb, hand, foot);
located outside the danger zone, with the exception of government whose function requires finding staff in the danger zone, and while there are additional security measures.

16. If management provides one control several different actions, the action to be displayed by means of the control and verifiable.

After stopping the machine and (or) equipment from the power source to the drive machinery and (or) equipment should be turned off, except when off power sources can cause a dangerous situation. Machine control system and (or) equipment (except for portable machines with manual control) must be equipped with means of emergency braking and emergency stop (off), if the application of these systems can reduce or prevent the danger.

19. Body emergency stop control must be: clear identifiable and easily accessible;
stop the machine and (or) equipment quickly without endangering; appear after actuation at a position corresponding
stop until he is returned to the user in the original position, and returns to its original position, without leading to the launch vehicle and (or)
hardware;
be red in color, shape and size differ from the other controls.

20. Management system of machines and (or) equipment must exclude the occurrence of danger as a result of their joint functioning, as well as in the event of failure of any part.
Management system of machines and (or) equipment should allow staff if necessary to block the launch of the system, as well as to stop her.

21. Remote control system of machines and (or) equipment must provide staff to supervise the absence of staff or other persons in hazardous areas or management should eliminate the functioning system of machines and (or) equipment when the staff or other persons in the danger zone. Each must be preceded by the launch warning signal duration which allows persons in the danger zone, leave it or prevent the launch of the system.
Remote control system of machines and (or) equipment shall be equipped with means of information on violations of any part of the operating system, as well as means of emergency stop (off) system and (or) its individual parts.

22. In the presence of the mode switch operation in machine control and (or) equipment each position must be exactly one mode of operation and held securely.

23. If a certain mode of machine operation and (or) equipment requires increased protection personnel, including data switch modes should provide:
Opportunity to block the automatic control, the motion of structural elements only at constant force is applied to the body motion control;
Shutdown machine and (or) equipment, if their work can cause danger to personnel;
exception of parts of the machine and (or) equipment not involved in the selected mode;
speed reduction of machine parts and (or) equipment involved in the selected mode.

24. Selection mode control must take precedence over all other operating modes except the emergency stop.

25. Total or partial cessation of power supply and its subsequent recovery, as well as damage to the power supply control circuit must not lead to dangerous situations, including:
automatic restart of the machine and (or) equipment when power is restored;
failure of issued commands to stop, drop and ejection of moving parts and (or) equipment and fixed objects on them, blanks and tools;
reduce the effectiveness of protective devices.

26. Violation (malfunction or damage) in the control circuit and the machine (or) equipment must not lead to dangerous situations, including:
automatic restart of the machine and (or) equipment when power is restored;
failure of issued commands to stop;
drop ejection and moving parts, and (or) the equipment and fixed on these subjects workpieces and tools;
reduce the effectiveness of protective devices.

27. Machine and (or) equipment must be provided for in the stable operating conditions ensuring their use without danger of overturning, falling or unexpected movement.
The manual (instruction) manual must specify the use of appropriate fasteners.

28. Machine parts and (or) equipment and their connections shall withstand the stresses and strains to which they are subjected in service.
Durability of the materials used must comply with the envisaged operation, consider the appearance of the hazard associated with the phenomena of fatigue, aging, corrosion and wear.

29. The manual (instructions) for operation of machines and (or) equipment shall be the type and frequency of inspection and maintenance required for safety. If necessary, must be specified parts subject to wear and the criteria for replacement.

30. If, despite the measures taken, there is a danger of destruction machine and (or) equipment, guards must be installed so that the destruction of parts or machine components and (or) equipment fragments could not fly away.

31. Piping shall withstand specified loads must be securely fixed and protected from external mechanical influences. Measures must be taken protection from dangerous consequences of the destruction, moved suddenly pipelines and high pressure jets at their destruction.

32. Precautions should be taken to prevent danger from discarded car and (or) equipment parts, fragments, waste.

33. Accessible parts of the machines and (or) equipment must not have sharp edges or sharp corners and rough surfaces that could cause injury and technologically unrelated to the functions of the machine and (or) equipment.

34. If the machine and (or) equipment designed to perform several different operations with manual movement of workpiece between each operation, it should be possible to use each functional element separately from other items that represent a hazard to personnel.

35. If the machine and (or) equipment designed to operate in different modes, speeds, it is necessary to ensure the safe and reliable choice and configuration of these regimes.

36. Moving parts of machines and (or) equipment shall be located so as not to an injury occurred, or if the danger persists, warning signs should be used and (or) label, safety or protective devices to avoid such contact with the machine, and (or) equipment that can lead to accidents.

37. Measures should be taken to prevent accidental blockage of moving parts. If, despite the measures taken, blocking may occur, should be provided special tools for safe release. Procedures and methods for unlocking must be specified in the user manual (instruction) manual and on the machine and equipment shall be applied to the appropriate designation.

38. Safety and protective devices used to protect against the danger caused by the moving parts of the machine and (or) equipment should be selected on the basis of risk analysis.

39. Safety and protective devices must: have a strong sustainable design;
be safe, placed at an appropriate distance from the danger zone;
not to interfere with the implementation of process control in hazardous areas;
allows to carry out adjustment and (or) replacement tool, as well as maintenance of machines and (or) equipment.

40. Fixed guards must be securely fixed so that access to the enclosing zone was only possible with the use of tools.

41. Movable guards must:
possible remain fixed to the machine and (or) equipment when they are open;
have locking devices that prevent operation of the machine or equipment until the guards are open.

42. Movable guards and protective devices must be designed (designed) and are included in the machine control system and (or) equipment so that:
moving parts can not be activated until they are within reach of personnel;
persons at the possible impact, were not within reach when turning;

set manually or automatically (depending on the type of operation in which they are involved);

44. Protective devices must communicate with the machine control system and (or) equipment so that:
moving parts can not be activated until they are within reach of the operator;
the staff could not be within reach of moving machine parts and (or) equipment at bringing them into action;
the absence or malfunction of one of the components of remedies preclude the inclusion or stop moving parts.

45. Protective devices shall be installed (removed) using only instruments.

46. If the machines and (or) equipment uses electrical energy, they must be developed (projected), constructed and installed so as to avoid the risk of electric shock.

47. If the machines and (or) equipment not used electric energy (hydraulic, pneumatic, thermal energy), they should be developed (projected) and manufactured in such a way as to avoid any hazards associated with these types of energy.

48. Errors when building machines and (or) equipment, which can be a source of danger, should be deleted. If this is not possible, should be applied to prevent the machine directly and (or) equipment.
Information about possible errors during reassembly must be given in the user manual (instruction) manual.

49. Necessary to eliminate the dangers posed by mixing liquids and gases, and (or) improper connection of electrical conductors for assembly. If this is not possible, information about this you must specify on the pipes, cables and (or) on the connecting blocks.

50. Measures must be taken to eliminate the risk caused by contact or proximity to machinery components and (or) equipment or materials with high or low temperatures.

51. Machine and (or) equipment should be developed (designed) so that there is no danger of fire or overheating caused by the machine itself, and (or) equipment, gases, liquids, dust, vapors or other substances produced or used vehicle and (or) equipment.
Machine and (or) equipment should be developed (designed) so that there was no unacceptable risk of explosion caused by the machine itself, and (or) equipment, gases, liquids, dust,
vapors or other substances produced or used vehicle and (or) equipment, which requires:
avoid dangerous concentration of flammable substances;
conduct continuous automatic control of the concentration of explosive substances;
prevent potentially explosive fire protection; minimize the effects of the explosion.

52. In developing (designing) machines and (or) the equipment necessary to ensure the noise parameters, infrasound, air and contact ultrasound does not exceed the machine during operation and (or) equipment.

53. The guide (manual) operating parameters should be set noise machines and (or) equipment and uncertainty parameters.

54. In developing (designing) machines and (or) the equipment necessary to ensure valid parameters produced by the vibration of staff.
The draft machines and (or) equipment must be provided acceptable risk caused by exposure to vibration produced by the staff.

55. For hand-held machines and machines with manual control, as well as machines equipped workplace for staff in the user manual (instruction) manual must specify the full corrected rms acceleration acting on the staff, and the uncertainties in estimating the parameters of the value.

56. Machine and (or) equipment should be developed (projected) and constructed so that ionizing radiation does not constitute a hazard.

57. When using laser equipment must be: prevented accidental radiation;
protected from direct, reflected, scattered and secondary radiation is no danger of optical equipment for the observation or adjustment of laser equipment.

58. In developing (designing) machines and (or) the equipment necessary to take measures to protect people from the adverse effects of non-ionizing radiation, static electric, static magnetic fields, electromagnetic fields of industrial frequency electromagnetic radiation of radio and optical ranges.

59. Gases, liquids, dust, vapors and other waste which emit machine and (or) the operation of equipment should not be a source of danger to human life and health and the environment.
In the presence of this the machine and (or) equipment must be fitted with devices to collect and (or) removal of these substances, which must be placed as close as possible to the source of isolation, as well as devices for continuous automatic monitoring of emissions.

60. Machine and (or) equipment must be equipped with means to prevent the closing of the staff inside the machine and (or) equipment that is impossible - signaling devices to call for help.

61. Machine parts and (or) equipment where staff may be necessary to develop (design) so as to prevent slipping, tripping or falling on them or staff with them.

62. Designated maintenance machines and (or) equipment shall be located outside danger zones.
Maintenance must be carried out as much as possible during machine stops and (or) equipment. If for technical reasons, these conditions can not be met, it is necessary to ensure that maintenance was safe.

63. Should be possible to install the machines and (or) equipment diagnostic equipment to detect faults.

68. The information needed to control the machine and (or) equipment must be clearly understood by staff. Information should not be excessive, so as not to overload the staff in the operation.

69. If the staff can be at risk due to malfunction, the machine and (or) equipment must be equipped with devices which set off an acoustic warning or signal light.
Signals given warning devices and machines (or) equipment must be clearly perceptible. Staff should be able to test the device alarm.

70. If despite the measures there is a risk, the machine and (or) equipment shall be provided with warning labels (signs), which should be clear and composed in Russian and in the state (s) language (s) of the Member State of the Customs Union in the presence of relevant requirements in the law (s) state () - member (s) of the Customs Union.

Annex № 2 to Technical Regulations of the Customs Union "On the safety of machinery and equipment" (TR CU 010 / 2011)

ADDITIONAL SAFETY REQUIREMENTS FOR CERTAIN CATEGORIES OF MACHINERY AND EQUIPMENT.

Agricultural and other self-propelled machines and mobile

1. Machine from which the occurrence of hazards associated with their motion shall additionally comply with the safety requirements stated in this annex.

2. Visibility from the operator should be sufficient to ensure the safety of the operator and located in a hazardous area personnel in the application of the machine and its working bodies for other purposes. If necessary, should be provided with the facilities required to address the dangers caused by poor visibility.

3. Operator, while in the workplace, should be able to activate the controls required to operate the machine. The only exceptions are those jobs that for security purposes should be performed using the controls located outside the operator's position.

4. The steering system of wheeled vehicles must be designed and constructed so as to reduce the stress on the steering wheel or control levers, arising as a result of external influences on the steered wheels.

5. The body of the differential lock control must be constructed and arranged so that when moving the machine has the possibility to produce unlocking the differential.
If the machine is to perform the production process for performing the specified functions equipment equipped exceeding its dimensions (e.g., stabilizers, arrows, etc.), then the operator should be able to start the movement to make sure that the equipment is in a predetermined position without create dangerous when moving the machine.
