foreword

1. This technical regulation of the Customs Union is developed in accordance with the Agreement on common principles and rules of technical regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation on November 18 2010 years.

2. This technical regulation of the Customs Union is designed to ensure the establishment of the common customs territory of the Customs Union unified mandatory for the application and enforcement of the requirements of the electromagnetic compatibility of technical means to ensure the free movement of technical equipment put into circulation at the common customs territory of the Customs Union.

3. If the technical means adopted by other technical regulations of the Customs Union, establish requirements for technical means, the hardware must meet the requirements of the technical regulations of the Customs Union, the action of which they are subject.

§ 1. Application area

1. This technical regulation of the Customs Union applies to put into circulation at the common customs territory of the Customs Union technical means capable of generating electromagnetic interference, and (or) the quality of the functioning of which depends on the influence of external electromagnetic interference.
2. This technical regulation of the Customs Union shall not apply to the technical means:
- Used by manufacturers other technical facilities as their component parts and are not intended for independent use;
- Passive with regard to electromagnetic compatibility;
- Not included in the Unified list of products for which mandatory requirements established in the framework of the Customs Union, approved by the Commission of the Customs Union (hereinafter - the Commission).
If the individual classes, groups and types of technical means are adopted technical regulations of the Customs Union, establish a fully or partially with more certainty requirements for electromagnetic compatibility, then with the date of application of these technical regulations of the Customs Union, the action of the present technical regulations of the Customs Union in respect of those technical funds and EMC requirements terminated.
3. This technical regulation of the Customs Union sets out the requirements for electromagnetic compatibility of technical means in order to ensure the common customs territory of the Customs Union to protect human life and health, property and the prevention of actions misleading consumers (users) technology.
4. This technical regulation of the Customs Union does not regulate the relations associated with the use of radio spectrum, which is regulated by national legislation, the States - members of the Customs Union in the field of communication.

§ 2. define

In the present technical regulations of the Customs Union the following terms and their definitions:

apparatus - Structurally completed technical means, having a housing (shell) and, if necessary, the device (ports) for external connections, intended for use by the consumer (user);
manufacturer - A legal entity or natural person as an individual entrepreneur engaged in production on its own behalf or the production and sale of technical equipment and are responsible for their compliance with the EMC requirements of the technical regulations of the Customs Union;
importer - A resident of the State - a member of the Customs Union, which concluded with a non-states - members of the Customs Union's foreign trade contract on the transfer of equipment, implements these technical resources and is responsible for their compliance with the EMC requirements of the technical regulations of the Customs Union;
component - Structurally completed part of a technical device intended to enable the consumer (user) of the vehicle; handling of technical means on the market - the processes of transition of technical resources from the manufacturer to the consumer (user) the common customs territory of the Customs Union, which held technical
means after the completion of its manufacture;
intended use - The use of technical means in accordance with the purpose specified by the manufacturer in this technical means and (or) operational documents;
technical means - Any electrical, electronic and radio-electronic products, as well as any product containing electrical and (or) electronic components, which can be categorized as: component, device and installation;
technical means, passive in respect of electromagnetic compatibility - technical means which, by virtue of its structural and functional characteristics when used as intended without additional protection against electromagnetic interference, such as screening or filtration, is unable to create electromagnetic interference, interfering with communications and other technical means in accordance with their purpose, and is operable without degradation when exposed to electromagnetic interference, electromagnetic environment appropriate for use which it is designed technical means (types of hardware, passive in respect of electromagnetic compatibility are listed in 1 annex to the present technical regulations of the Customs Union);
person authorized by the manufacturer - Legal or natural person registered in the established state order - a member of the Customs Union as defined by the manufacturer on the basis of a contract with him for action on behalf of a conformity assessment and placement of products on the single customs territory of the Customs Union, as well as for imposing liability for non-compliance production technical regulations of the Customs Union requirements;
installation of (mobile or stationary) - A set of interconnected devices and, if necessary, other articles intended for use by the consumer (user) as a product with a common functional purpose and having common technical documentation;
resistance to electromagnetic interference (noise immunity) - The ability of the technical means to maintain a predetermined quality of operation when subjected to external electromagnetic interference with regulated values ​​of the parameters;
electromagnetic compatibility - The ability of the technical means to function with a given quality at a given electromagnetic environment and not cause harmful electromagnetic interference to other technical facilities;
electromagnetic environment - A set of electromagnetic phenomena and processes in a given region of space;
electromagnetic interference - Electromagnetic phenomenon or process that reduces or may reduce the quality of the functioning of the technical means.

§ 3. Handling on the market

1. Technical means available in circulation in the market when it is under the present technical regulations of the Customs Union, as well as other technical regulations of the Customs Union, the action of which it is subject, and provided that it has passed demonstration of compliance in accordance with article 7 of the present technical regulations of the Customs Union, as well as according to other technical regulations of the Customs Union, the action of which it is subject.
2. Technical means conformity which the requirements of this technical regulation of the Customs Union has not been confirmed, must be marked by a single sign of products on the market states - members of the Customs Union and is not allowed to be released into circulation in the market.
3. Technical means, not marked by a single sign of products on the market states - members of the Customs Union, is not allowed to release into circulation on the market.

§ 4. Requirements for Electromagnetic Compatibility

Technical equipment must be designed and manufactured in such a way that when it is used as intended, and the performance requirements for the installation, operation (use), storage, transportation (transportation) and maintenance:
- Electromagnetic interference caused by technical means do not exceed a level that ensures the operation of communications equipment and other technical means in accordance with their intended use;
- Means has technical level of resistance to electromagnetic interference (noise immunity), providing its function in the electromagnetic environment for applications in which it is intended.
Types of electromagnetic interference caused by technical means and (or) acting on the technical means are shown in 2 annex to the present technical regulations of the Customs Union.

§ 5. Labeling requirements and operational documents

1. Name and (or) the designation of the technical equipment (type, make, model - if available), its basic parameters and characteristics, the name and (or) the trademark of the manufacturer, the name of the country where manufactured technical means, must be applied to the technical means and indicated in the annexed operational documents.
In this case the name of the manufacturer and (or) its trade mark, name and designation of the technical equipment (type, make, model - if available) should also be applied to the packaging.
2. If the information listed in paragraph 1 of this article, can not be applied to the technical means, they can be specified only in the attached to this technical means of operational documents. In this case the manufacturer's name and (or) its trade mark, the name and
the designation of technical equipment (type, make, model - if available) should be marked on the packaging.
3. Marking technical means shall be legible, easy to read and apply technical means available for inspection without disassembly using the site tool.
4. Operational documents to the technical means should include:
- The information listed in paragraph of this article 1;
- Information concerning the appointment of technical means;
- Characteristics and parameters;
- Rules and conditions for installation of technical means it is connected to the electric grid and other technical means, the start, control and commissioning if the implementation of these terms and conditions is required to ensure compliance with the technical means of the requirements of this technical regulation of the Customs Union;
- Information about the limitations in the use of technical means in view of its purpose for use in residential, commercial and industrial areas;
- The terms and conditions of safe operation (use);
- The terms and conditions of storage, transportation (transportation), sale and disposal (if necessary - the establishment of requirements to them);
- Information on the measures to be taken in case of fault of technical means;
- The name and address of the manufacturer (the person authorized by the manufacturer), the importer, information to contact them;
- Month and year of manufacture of technical means and (or) information on the site of application and the method of determining the year of manufacture.
5. Operational documents executed in Russian and in the state (s) language (s) of the State - a member of the Customs Union with the appropriate requirements of the law (s) state (in) - member (s) of the Customs Union.
Operational documents executed on paper. These can be attached set of operational documents in electronic format. Operational documents, the supplied hardware products, household products, can only be performed on electronic media.

§ 6. Ensuring compliance with the requirements for electromagnetic compatibility

1. Compliance with the technical means of the present technical regulations of the Customs Union is provided by the implementation of its requirements for electromagnetic compatibility, either directly or fulfillment of requirements of the standards included in the List of Standards, as a result of which, on a voluntary basis, compliance with the requirements of technical regulations of the Customs Union.
2. Research methods (tests) and measurements of technical tools are installed in the standards included in the list of standards containing rules and research (testing) and measurement methods, including sampling rules, required for application and performance requirements
technical regulations of the Customs Union and the implementation of evaluation (confirmation) of conformity.

§ 7. Confirmation of compliance

1. Before the release into circulation in the market of technical means should undergo confirmation of compliance with the requirements for electromagnetic compatibility of these technical regulations of the Customs Union.
Conformity assessment is carried out by means of technical schemes, established in the present technical regulations of the Customs Union, in accordance with the Regulation on the application of standard assessment schemes (confirmation) of conformity to technical regulations of the Customs Union, approved by the Commission.
2. Technical tools included in the List given in 3 to this technical regulation of the Customs Union of the application, shall be subject to conformity assessment in the form of certification (1s scheme 3s, 4s).
Technical equipment is not included in the above list are subject to conformity assessment in the form of declaration of conformity (1d scheme 2d, 3d, 4d, 6d). Selecting the declaration of conformity scheme of means, not included in the list, is carried out by the manufacturer (person authorized by the manufacturer), importer.
According to the decision of the manufacturer (manufacturer's authorized representative), importer conformity assessment of technical equipment, not included in the list, can be carried out in the form of certification in accordance with paragraph of this article 5.
In the case of non-application of the standards referred to in paragraph article 1 6 this technical regulation of the Customs Union, or in their absence,
confirmation of compliance with the technical means implemented in the form of certification (1s scheme 3s, 4s) in accordance with paragraph of this article 10.
3. Certification of technical means, mass-produced, is carried out under the scheme 1s. Technical means for the certification is the manufacturer (person authorized by the manufacturer).
Certification party hardware made by the scheme 3s, a single product - the scheme 4s. Party hardware (single product) manufactured within the common customs territory of the Customs Union, is a manufacturer, the lot of facilities (single product), imported into the common customs territory of the Customs Union, is the importer or the manufacturer (person authorized by the manufacturer).
4. Certification of technical equipment held by the certification body (conformity assessment (confirmation) of conformity), included in the Unified Register of certification bodies and testing laboratories (centers) of the Customs Union.
Tests for certification carries an accredited testing laboratory (center) included in the Unified Register of certification bodies and testing laboratories (centers) of the Customs Union.
5. In carrying out certification of technical means (1s scheme 3s, 4s):
5.1. manufacturer (manufacturer's authorized person), an importer provides the certification authority (assessment (confirmation) of conformity) a set of documents on the technical means of verifying compliance with the technical means of the EMC requirements of the present technical regulations of the Customs Union, which includes:
- Technical conditions (if any);
- Operational documents;
- List of standards, requirements of which must conform to this technical device from the list of standards referred to in paragraph article 1 6 this technical regulation of the Customs Union;
- Contract (supply contract) or shipping documentation (for a batch of technical means (single product) (scheme 3s, 4s);
5.2. The manufacturer shall take all measures necessary so that the manufacturing process was stable and ensures compliance of the manufactured hardware requirements of the present technical regulations of the Customs Union;
5.3. certification body (conformity assessment (confirmation) of conformity)
5.3.1. performs sample (s) selected;
5.3.2. carries out the identification of technical means by establishing the identity of its performance characteristics, laid down in Article 1 of the present technical regulations of the Customs Union, the provisions established in Article 5 of the present technical regulations of the Customs Union, and the documents listed in paragraph 5.1 5 paragraph of this article;
5.3.3. organizes sample tests (samples) the technical means for compliance with standards from the List of standards referred to in paragraph article 1 6 this technical regulation of the Customs Union, and conducts protocol analyzes (protocol) tests;
5.3.4. analyzes the state of production (1s scheme).

If you have a manufacturer-certified Quality Management System and development and production of technical means estimates the possibility of the system to ensure stable production of certified technical means of meeting the requirements of this technical regulation of the Customs Union;

5.3.5. issue a certificate of compliance for a single form approved by the Commission. The validity of the certificate of conformity for the equipment, mass-produced, - no more than 5 years for party hardware (single product) conformity certificate validity is not established;
5.4. manufacturer (manufacturer's authorized person), importer:
5.4.1. causing a single sign of products on the market states - members of the Customs Union;
5.4.2. forms after a set of documents on the technical means complete conformity assessment, which includes:
- The documents referred to in subparagraph 5.1 of this paragraph;
- Protocol (s) testing;
- The results of the analysis of production conditions;
- certificate of conformity.
5.5. the certification body (conformity assessment (confirmation) of conformity) conducts inspection control of certified technical means by testing samples in an accredited testing laboratory (center) and (or) the analysis of production conditions (1s scheme);
6. Declaration of conformity of the technical means (1d scheme 2d, 3d, 4d, 6d) is carried out on the basis of:
6.1. own evidence (1d scheme, 2d):
- Testing of technical means (for party hardware, a single product) (2d scheme);
- Testing of technical equipment and production control by the manufacturer (for the equipment, mass-produced) (1d scheme);
6.2. evidence obtained with the participation of accredited testing laboratory (center), the certification body of quality management systems included in the Unified Register of certification bodies and testing laboratories (centers) of the Customs Union (3d scheme, 4d, 6d)
- Testing of technical means (for party hardware, a single product) (4d scheme);
- Testing of technical equipment and production control by the manufacturer (for the equipment, mass-produced) (3d scheme);
- Testing of technical means certification of the quality management system, or developing and manufacturing hardware and production control by the manufacturer (for the equipment, mass-produced) (6d scheme).
6.3. Declaration of conformity of technical devices, mass-produced, carries the manufacturer (person authorized by the manufacturer) on schemes 1d, 3d, 6d.
Declaration of Conformity party hardware (single product) carries the manufacturer (person authorized by the manufacturer), the importer under schemes 2d, 4d.
7. When declaring the conformity of technical means on 1d schemes,
2d:
7.1. manufacturer (manufacturer's authorized person), importer:
7.1.1. generates a set of documents confirming compliance
technical means of requirements of the present technical regulations of the Customs Union, which includes:
- Technical conditions (if any);
- Operational documents;
- List of standards, requirements of which corresponds to the present technical means, from the List of standards referred to in paragraph article 1 6 this technical regulation of the Customs Union;
- Protocol (s) of tests carried out in the test laboratory (center) at the option of the manufacturer (the person authorized by the manufacturer), importer;
- The certificate of conformity (if any);
- The declaration of conformity the manufacturer (if available) (for party hardware (single product) (2d scheme);
- Contract (supply contract) or shipping documentation (for a batch of technical means, a single product) (2d scheme);
7.1.2. carries out the identification of technical means by establishing the identity of its performance characteristics, laid down in Article 1 of the present technical regulations of the Customs Union, the provisions established in Article 5 of the present technical regulations of the Customs Union, and the documents listed in paragraph 7.1.1. 7.1 paragraph of this article;
7.2. The manufacturer carries out production supervision and takes all necessary measures to ensure that the manufacturing process ensures conformity of the technical means of the requirements of this technical regulation of the Customs Union (1d scheme).
Requirements for manufacturing processes and controls, as well as the results of their control should be documented (in the form prescribed by the manufacturer);
7.3. manufacturer (manufacturer's authorized person), importer:
7.3.1. receives a written declaration of conformity with the technical means of the present technical regulations of the Customs Union on a single form approved by the Commission and deals
7.3.2. including after the completion of verification of conformity to a set of documents on the technical means given in subparagraph 7.1.1. of this paragraph, a declaration of conformity.
8. When declaring the conformity of technical means on schemes 3d, 4d, 6d:
8.1. manufacturer (manufacturer's authorized person), importer:
8.1.1. generates a set of documents on the technical device, which includes:
- Technical conditions (if any);
- Operational documents;
- List of standards, requirements of which must conform to this technical device from the list of standards referred to in paragraph article 1 6 this technical regulation of the Customs Union;
- Contract (supply contract) or shipping documentation (for a batch of technical means, a single product) (4d scheme);
- Certificate of conformity for the production of a quality management system, or developing and manufacturing hardware (6d scheme);
8.1.2. carries out the identification of technical means by establishing the identity of its performance characteristics, laid down in Article 1 of the present technical regulations of the Customs Union, the provisions established in Article 5 of the present technical regulations of the Customs Union, and the documents listed in paragraph 8.1.1. 8.1 points. of this article;
8.1.3. organizes the specimen (s) testing technical means for compliance with standards from the List of standards
8.2. Manufacturer:
provides production control and take all necessary measures to ensure that the manufacturing process ensures conformity of the technical means of the requirements of this technical regulation of the Customs Union (3d scheme, 6d). The requirements for production processes and controls, and the results of their controls should be documented (in the form prescribed by the manufacturer);
take all necessary measures to ensure that the manufacturing process and stable operation of the production quality management system and the development and production ensure compliance with the technical means of the requirements of this technical regulation of the Customs Union (6d scheme);
8.3. manufacturer (manufacturer's authorized person), importer:
8.3.1. receives a written declaration of conformity with the technical means of the present technical regulations of the Customs Union on a single form approved by the Commission, and inflicts a single sign of products on the market states - members of the Customs Union;
8.3.2. forms after a set of documents on the technical means complete conformity assessment, which includes:
- The documents referred to in subparagraph 8.1.1 8.1 paragraph of this article;
- Protocol (s) testing;
- A declaration of conformity.

The validity of the declaration of compliance for the equipment, mass-produced, - no more than 5 years for party hardware (single product) duration of the declaration of conformity is not installed.
10. In carrying out certification of technical means, in the case of non-application of standards from the List of standards referred to in paragraph article 1 6 this technical regulation of the Customs Union, or in their absence (1s scheme, 3s, 4s):
10.1. manufacturer (manufacturer's authorized person), an importer provides the certification authority (assessment (confirmation) of conformity) a set of documents on the technical means of verifying compliance with the technical means of the EMC requirements of the present technical regulations of the Customs Union, which includes:
- Technical conditions (if any);
- Operational documents;
- A description of the technical solutions, confirming compliance with the requirements for electromagnetic compatibility of these technical regulations of the Customs Union;
- Contract (supply contract) or shipping documentation (for a batch of technical means (single product) (scheme 3s, 4s);
10.2. The manufacturer shall take all measures necessary so that the manufacturing process was stable and ensures compliance of manufactured
hardware requirements of the present technical regulations of the Customs Union;
10.3. certification body (conformity assessment (confirmation) of conformity)
10.3.1. performs sample (s) selected;
10.3.2. carries out the identification of technical means by establishing the identity of its performance characteristics, laid down in Article 1 of the present technical regulations of the Customs Union, the provisions established in Article 5 of the present technical regulations of the Customs Union, and the documents listed in subparagraph 10.1 10 paragraph of this article;
10.3.3. carries out conformity assessment of technical means itself the EMC requirements of the present technical regulations of the Customs Union.
At the same certification authority (assessment (confirmation)):

- Based on the requirements of the electromagnetic compatibility of the technical regulations of the Customs Union and the conditions of electromagnetic environment for the application in which the technical product is intended, it defines the specific EMC requirements for the certified technical means;
- Analyzes of the technical solutions, confirming compliance with the requirements for electromagnetic compatibility of these technical regulations of the Customs Union of the manufacturer;
- Determines from the List of standards referred to in paragraph article 2 6 this technical regulation of the Customs Union, standards establishing measuring and testing methods, or in the absence thereof, determines the methods of control, measurement and test to confirm
appropriate technical means specific requirements for electromagnetic compatibility;
- Organizes the testing of technical means and conducts protocol analyzes (protocol) tests;
10.3.4. analyzes the state of production (1s scheme);

If you have a manufacturer-certified Quality Management System and development and production of technical means estimates the possibility of the system to ensure stable production of certified technical means according to the requirements of the present technical regulations of the Customs Union;
10.3.5. issue a certificate of compliance for a single form approved by the Commission.

10.4. manufacturer (manufacturer's authorized person), importer:
10.4.1. causing a single sign of products on the market states - members of the Customs Union;
10.4.2. forms after a set of documents on the technical means complete conformity assessment, which includes:
- The documents referred to in subparagraph 10.1 of this paragraph;
- Protocol (s) testing;
- The results of the analysis of production conditions;
- certificate of conformity;

10.5. the certification body (conformity assessment (confirmation) of conformity) conducts inspection control of certified technical
by means of testing samples in an accredited testing laboratory (center) and (or) the analysis of production conditions (1s scheme).
11. Upon confirmation of compliance of fixed installations by the decision of the manufacturer's technical documentation is examined to ensure electromagnetic compatibility, as well as settlement and applied experimental methods, documented the results of which are to be included in a set of documents on technical means.
12. A set of documents on the technical means to be stored in the territory of States - members of the Customs Union:
- Technical means - from the manufacturer (person authorized by the manufacturer) for a minimum of 10 years from the date of withdrawal (termination) from the production of technical means;
- Party hardware - the importer or the person authorized by the manufacturer for at least 10 years from the date of implementation of the last articles of the party.

§ 8. Marking a single sign of products on the market states - members of the Customs Union

1. Technical means of meeting the requirements for electromagnetic compatibility of these technical regulations of the Customs Union and the elapsed conformity assessment procedure in accordance with article 7 of the present technical regulations of the Customs Union must be marked with a single sign of products on the market states - members of the Customs Union.
2. Marking a single sign of products on the market states - members of the Customs Union is carried out before the release of the technical means in circulation in the market.
3. A single sign of products on the market states - members of the Customs Union is applied to every technical means in any way, providing crisp and clear images for all technical means life, as well as provided in the annexed operational documents.
4. It is allowed to apply a single sign of products on the market states - members of the Customs Union only on the packaging and in the technical means of the annexed operational documents if it can not be applied directly to the technical means.
5. Technical means of labeled single sign of products on the market states - members of the Customs Union in its compliance with the requirements of technical regulations of the Customs Union, the action of which it is subject, and provide for the application of the mark.

§ 9. Safeguard clause

States - members of the Customs Union are obliged to take all measures to restrict, prohibit the release into circulation of means in the common customs territory of the Customs Union, as well as the withdrawal from the market of means that do not meet the requirements of the electromagnetic compatibility of the technical regulations of the Customs Union.

1 Annex to the technical regulations of the Customs Union "Electromagnetic compatibility of technical equipment" (TR CU 020 / 2011)

Types of hardware, passive in respect of electromagnetic compatibility, are not covered by the technical regulations of the Customs Union "Electromagnetic compatibility of technical equipment" (TR CU 020 / 2011)

1. Wires, cords, cables and cable assemblies.
2. Technical equipment containing only resistive load and with no automatic switching devices, such as household electrical heaters without fans or thermostats.
3. Electric batteries and is powered by their light equipment without active electronic circuits.
4. Headphones and speakers without amplification functions.
5. Protective equipment, creating transient electromagnetic interference of short duration (much less 1s) as a result of tripping due to a short circuit or an abnormal situation in a circuit, does not contain a preservative (emergency shutdown device) with active electronic parts.
6. High-voltage equipment in which possible sources of electromagnetic interference caused only localized defects of isolation (eg, inductors, high-voltage, high-voltage transformers), provided that such equipment does not contain any active electronic parts.
7. Capacitors, for example, for power factor correction capacitors.
7. Induction motors.
8. Quartz watches (without additional functions, eg radio).
9. Incandescent lamps.
10. Plugs, sockets, fuses, switches and circuit breakers without active electronic circuits.
11. Passive antenna for the reception of radio and television.

2 Annex to the technical regulations of the Customs Union "Electromagnetic compatibility of technical equipment" (TR CU 020 / 2011)

Types of electromagnetic interference caused by technical means and (or) acting on a technical device, which is covered by the technical regulations of the Customs Union "Electromagnetic compatibility of technical equipment" (TR CU 020 / 2011)

1. Low frequency conductive electromagnetic interference:
- Set the power supply voltage deviation;
- Distortion sine wave power supply voltage;
- Voltage unbalance in three-phase power supply systems;
- Fluctuations in the power supply voltage;
- Failures, interruption of power supply voltage and emissions;
- The frequency deviation in power supply systems;
- Voltage signals transmitted in the power supply systems;
- DC components in the AC networks;
- Induced low-frequency voltage.
2. Low-frequency radiated EMI:
- Magnetic fields;
- Electric fields.
3. High conductive electromagnetic interference, including interference Industrial:
- Voltages or currents, which are continuous fluctuations;
- Voltages or currents, which are transient (aperiodic and vibrational).
4. High-frequency radiated electromagnetic interference, including interference Industrial:
- Magnetic fields;
- Electric fields;
